A few posts ago someone said they had contacted Consumer Direct who confirmed that an Out of Date SEL is still an offer to charge that price. Now I am reading that Tesco HO is stating that Out of Date SEL's do not count if they have been used as a price guide for an RnR. Is there somebody on this forum who can actually confirm which of the two bodies are right regarding the legal position for the Consumer? I would love to find out Tesco were in the wrong and go after them if they tried to tell me an out of date SEL did not have any affect on the price I was charged in store. Because if that is the case Tesco might as well do away with it's price integrity team and place outdated signs all over the shop so no one has a clue what they are supposed to be being charged until they go through the till!

stay friendly calm and firm if they dont honour it u have nothing to lose if they do honour it you gain. it is their policy to reimburse you the money and keep the product

Just go for it michica. If they say the SEL is out of date just say politely that you are sorry but that is not your problem. The policy is there in Blue and White and they will probably try and offer you the difference. Just say, sorry but when you overcharged me on peanuts last month I got a full refund, what is the difference? You never know they may know what they are doing and just refund you.
We took on Mr T and we won:D

Shame it had to end, will have to get free stuff from comps now

Just got 2xorganic half leg of lamb. The price p/kg was 8.28 on sel, but 8.29 on pck, the interesting bit was that the price per pound was the same, thought i was going to lose that one but argued that the difference was 1p in the price after 20 mins i won the argument, cheers mr T
if i had known then what i know now

So what is the deal with the mobile phones?, is the £20 off discount not working on certain phones? or are all the r&r's based on the October 10% off promotion?.

Appreciate comments from anyone who can clarify

    Thanks

I'm still catching up with my reading...

But I think the Till Dude has to manually key in the discount...

...so if they forget you are in!

As for the expired 10% offer - I selected 3 phones at random yesterday - all scanned at a lower price than the old SEL!

Wish I'd had access to MSE last night - hey ho.

If two or more prices are displayed for the same product the lowest price MUST be charged in order to avoid committing an offence. The expiry date on pos material is of no consequence to you as the consumer, if it is out of date it should be removed, if not removed it MUST be honoured or the goods removed from sale, if you have been charged a higher price than the LOWEST price displayed the store has committed an offence.

So you can CATEGORICALLY claim that NO CS bod is EVER instructed by management in the store to just give the difference of the overcharge and see what happens?

Ha ha ha ... I was in a store yesterday and the CS rang the Manager about a large overcharge. I was stood close enough to hear both sides of the conversation.

After the end of the call the CS sheepishly turned to me and said "You heard that didn't you? He asked if you'd like me to refund the difference."

I just asked what she thought she should do.

I am not denying your posted definition of an overcharge however, and you should have noted that I have also not queried anyones claim that they have been overcharged when the discount has not been applied!!

Indeedy do - good to see my copy is still spot on then........
