For new readers:

For clarification SEL stands for Shelf Edge Label and R and R stands for Refund and Retain. The Tesco policy on signs instore is :-

"And if things don't add up ~ In the unlikely event you are charged a higher price than on the shelf or the product we will refund your money and you can keep the product"

Compare the price per kilo on the pack with the shelf edge label price per kilo and where there is a difference the lowest price must be charged.
Thanks to !!!!!! Dastardly for providing the following information from the DTI website which summarises consumer rights in relation to misleading price indications:

Q1. I was charged a different price for an item at the till to the one that was shown on the shelf, what are my rights?

The Consumer Protection Act 1987 makes it an offence for a trader to give a consumer misleading price indications. In the first instance speak to the trader about the differing prices, if you are not satisfied with the response, contact your local authority trading standards department who enforce the Act and who could bring a prosecution against the trader.

    Had a good day today

    Visited 7 stores and was unsuccessful at only 2...although they proved the most fruitful.
    From the other 5 stores I managed 9 boxes of Becks Vier (12s), and 36x4 500ml tinnies of Fosters......all CS were wonderful.....one tried to just "give me the difference" whilst the others gave me a full refund without me even asking.

    For those wondering about quantity....they came like this

    3 Becks(3x£7.99)
    3 Becks(3x£7.99)
    3 Becks and 12x4 Fosters(3x£7.99 and £37.80)
    12x4 Fosters (£37.80)
    12x4 Fosters (£37.80)

    The icing on today's cake was the fact that the 2 stores that "got everything correct, each gave me refund of £200+ in exchange for a previously RandRed PSP and game.....................I just told them both that my son preferred his XBox.

    Took them back under the 28 day rule,(although they didnt know they were previously RandR'ed.....havent got that brave yet)

    Thats a cool £600ish.........Time to hibernate for a while

  • As an r&r virgin, i would like to know how you know if something will quailify for r&r.
    The barcode scanners in my local T are never working, so what do you do if everything is correct?
    Advice would be appreciated as i dont want to make a prat of myself and end up buying things i might not really want.

  • Posted earlier as i had purchased a fuji finpix v10 5mp digital camera for £219.97 on the 11th even thought the sel and pos stated it was on offer for £199.79.
    Had a terrible time trying to get my refund as the offer had expired on the 10th. Even phoned dundee head office who explained that the policy does not stand as it is not an overcharge if the offer is out of date. I did say that sometimes offers get extended and the pos and sel stay up :wall:
    Now i find that no more than 24 hours later on the 12th the camera has been reduced to 179.97 :mad:

    Can someone please advise me on my next step

    got some aberdeen angus burgers R&R this afty, but whilst i was getting them off the shelf, i saw 4 packets that were dated BBE 9th oct, and today is the 12th :eek:

    i pointed them out to the CS girl when she went to get the SEL but she left them on the shelf and said it wasn't her job to remove them......

    i know its an offence to leave out of date food on a shelf, so what should i have done? i'm sure i read that stores are fined thousands for out of date goods

    Well, guess what happened to me this morning???

    Yep, a banning! Wouldnt mind but it was only while getting an R&R on a Burbs DVD! (stickered £5.97 scanned at £9.9? BTW ;) )
    Got my refund then was "had a word with" by the "security guard" (you know, the waif looking beanpole type) he said he knew what I was doing as he'd been watching me and that I am in there "every day" getting refunds (today was only the third time this week)

    He said he had the authority of the store manager to ask me to leave and not come back and that I was welcome to phone and talk to manager or phone head office.

    I must admit, credit to the bloke, he did stop shaking after he realised I was being civil about it, I did quite loudly state my protest in the middle of the entrance but didnt really cause that much of a scene, couldnt really be bothered!

    But heres the kicker..

    Went into another store this afternoon (about 30 or so miles away from above store) and they were all over me like a cheap suit, was practically followed around the whole store and saw/overheard staff nudging each other saying "yeah thats the one" and that sort of thing, I did have a basket of Fosters (which I was going to R&R ;) ) and went to the basket only checkout, while I was waiting I noticed a few more members of staff standing over at the CS desk and also the manager was standing over with the "security guard" (short greasy type this time) I knew it was the manager as it was him that isssued my R&R on a PSP a couple of weeks ago (after being told to by KK at HO)

    Dont go into that store that often so cant think why I got all that attention unless the above store had circulated my details?

    TAXIPHIL - Can you PM that email address you were on about in earlier posts about someone dealing with this?

    After that crushing blow (YEAH RIGHT! :rolleyes: ) this morning, I am now "consoling" (excuse the pun) myself playing on my Xbox360 while drinking becks vier and munching on Doritos, not that I need to after my massive dinner of organic sirloin steak washed down with montana sauvignon blanc.

    wonder where that came from.......:A
    Missing Tesco R&R since Feb '07 :A & now a "Tesco veteran" apparently! ;)

    did you get a copy of the SEL?

    Trading Standards and the ASA would be my next port of call, showing them your receipt, the SEL and a copy of tesco's price promise

    The barcode scanners in my local T are never working, so what do you do if everything is correct?

    Something usually qualifies for an RandR if it is mispriced....ie...The shelf edge label shows a lower price than the articles (till) price. This is usually caused by the SEL being out of date.

    However.....there is no hard and fast rule about this.

    If you were charged the correct price(no RandR), you can always take the article(non food) back for full refund within 28 days.

    There is lot more to this than I have stated above.....too much to answer in one....try one thing....then when you get a bit confidence you will progress from there.

    so you had previously been refunded on these under the policy, but then took them back to get (another) cash refund? If that is the case, then that is obtaining pecuniary advantage by deception* and is fraudulent.


    * that's a modern day, polite term for theft but whichever way you dress it up in language, it's still theft.

    i always check the misprice board, and if theres anything i fancy, i see if its got the wrong SEL up in my local store. if it has...great. if it hasn't, either don't get it, or risk it, then take it back for a refund if you don't really want it.
