    This happened to me today with an item, no working scanner and no self sevice tills. I put my possible rr item through first - it came up at the out of date SEL price:confused: ; my few other items of shopping went through and then I asked the cashier to cancel the item as 'I didn't have enough cash on me for all of my shopping'. I hope that this helps and good luck.

    got some aberdeen angus burgers R&R this afty, but whilst i was getting them off the shelf, i saw 4 packets that were dated BBE 9th oct, and today is the 12th :eek:

    i pointed them out to the CS girl when she went to get the SEL but she left them on the shelf and said it wasn't her job to remove them......

    i know its an offence to leave out of date food on a shelf, so what should i have done? i'm sure i read that stores are fined thousands for out of date goods

    I took them to a manager who expressed appropriate horror, fulsome thanks and marched away purposefully.......my sympathies to the whoever whose section/responsibility it was.

    well i could be wrong, but if you're getting no joy from HO i would definitely go to TS and ASA, because as far as TS are concerned, it doesnt matter if an SEL is out of date.....they still have to sell it to you at that price. once money has exchanged hands, a contract has been made, but tesco have broken that contract by charging you more than the SEL, therefore you should be entitled to R&R

    Although we have clashed on this thread before I think you genuinely need to be very careful about doing this sort of thing. Because you have received money from Tesco's for goods they have already refunded you on. It could well be seen as fraud.

    I hope you did not use a switch or credit card as they will have 'data mining' software that looks for unusual patterns i.e. more than one large refund.

    I would do most things, but I would not do what you have done.

    * that's a modern day, polite term for theft but whichever way you dress it up in language, it's still theft.

    According to Tesco's blue Policy board....Rand R doesnt affect your Statutory Rights......

    Also according to Tesco's Policy Board....If you are unhappy in any way with your goods, you can return them for a full refund within 28 days......

    As your Statutory Rights aren't affected by RandR, and I am unhappy with the goods, and have returned them to Tescos........wheres the problem......I didnt write the policy.....This has been thrashed out before......

    Earlier today I posted a post with regards to a yellow shelf offer label for a £50 reduction of an Acer laptop in my local store - price showed £349.99 with the discount - however the label expired a couple of days ago and so the laptop should now be back to the original price of £399.99. I asked a eleccy guy how much they were and he came back and said that the scanned item was £399.99.

    As I am still an R&R virgin, I would like to take the plunge in style :D , would I be likely in succeeding in this ? Does the R&R policy apply to expired dates as it is pretty clear on the label, would I have been expected to know that the offer has expired - this is the area which is causing me the most concern from having a good go for it! As I dont really need a new laptop - if I attempted the R&R, could I get a full unconditional refund if it didnt work out - I wouldnt like to be £349 out of pocket!! :rotfl:

    As a final afterthought, if I attempt to pursue this in store and get the inevitable and expected decision that I cannot get the R&R, how do I make a record of the shelf label - in other words what's stopping them from removing it knowing I would take the matter to HO in the morning, would I be right in assuming my evidence would subsequently be gone and any claim with it?

    £3.39 for 4. buy 2 for £6

    The latest shelf edge label is

    £3.39 for 4. buy 2 for £6.30

    Some stores either have the old one still up, or both up together...either way if they charge you £6.30 you should get a refund.(Some just have the 2 for £6.30 up...in which case you'll get no refund.)

  • Surprised about Park Rangers post re TS - I thought that stores HAD to refund the difference if they overcharged - am I reading you right that they don't, that they can charge you whatever they like - legally - despite what the ticket/sel/advert/pos says ?
    So therefore ALL stores who refund the difference are being 'generous'

    Don't really want to get into a debate on this as I only know what I was told and could easily get out of my depth on this one. But, basically - Yes. As I understand what he said once you've paid you've accepted the price and don't have a legal right to refund. But TS could hammer them for incorrect pricing. (If they have the time and the money). So I wouldn't describe them as being generous. They've either got a good Customer Relations policy or they hope it will stop you from reporting them.
    I've lifted this off the TS website from a Q&A section

    "I want to purchase a three piece suite that is on display in a shop. The shop refused to sell it to me. Does a shop have the right to refuse to sell goods?"
    Yes! Goods on display in a shop are there for you to make an offer to buy, the shop is not obliged to accept your offer. The same applies where goods have been labelled with the wrong price; the shop does not have to sell at that price.

    Re: Different prices, different stores.

    There was a few posts towards the end of the last thread about this (I go away for a day and you all move on me :eek: :D ). Here are a couple of possible explanations -

    1. IT issue. Its possible that store X had an issue running its overnight update and store Y didn't. That, btw, is also why some miss prices occur...there are backups, but they are not as accurate.

    2. Store specific pricing. This especially applies to discontinued product. It gets a little complicated...but basically is designed so that all stores sell through on an item at the same time, regardless of the quanitity they have and their relative turnover. So if store X has 100 of something that it will take 4 weeks to sell and store Y has 200 but it will take them 8 weeks to sell, the discount will be more aggresive in store Y (or less in X).

    There you go. Clear as mud ;)
