  • Aberdeen Angus burgers are £1.99 in my local Tescos, it is odd how the same things can be different prices isn't it?
Real men never follow instructions; after all they are just the manufacturer's opinion on how to put something together. :p

so you had previously been refunded on these under the policy, but then took them back to get (another) cash refund? If that is the case, then that is obtaining pecuniary advantage by deception* and is fraudulent.

    * that's a modern day, polite term for theft but whichever way you dress it up in language, it's still theft.

Firstly - Theft and Deception are not the same thing.

Secondly - Tesco hasn't suffered a loss, therefore no theft. Also no deception, as no percuniary advantage gained. It's a simple swap.

Leadhead has dealt with the other issues.

I had an issue with some Finest ready meals last week. CS refused refund on the basis that the discount had already been applied to the SEL price (SEL said £1 discount deducted at checkout) and I had simply misread the label. To me, the price was unequivocal. SEL price LESS £1.00 at checkout.

I telephoned HO, who said they would take the matter up with the store, heard nothing, so phoned last Friday. They had no record of my earlier call! However, said that it could be that someone is dealing and has not put it on their system, so give them another day.

Today, I phoned again, and again no record of either of my calls last week!

Since last week, I have discovered that the SELs have now been amended to read "Save £1 when you by two", which I suspect was supposed to be the offer all along. However, the provisions manager misled me, by saying that each item was indeed reduced by £1, and that the deduction had already been made within the price.

HO today confirmed that the prices I paid are in fact the normal prices, and not reduced prices, and that they would speak to the store, and come abck to me.

I then reminded them that I have the SELs (they were mistakenly put in my bag with my shopping) and that I have referred the matter of the misleading pricing to TS.

The lady then said that, as TS are acting for me, they cannot deal with my overcharge query until that has been dealt with.

I tried to explain that TS are not acting for me. They have no interest in my overcharge or the matter between Tesco and myself. I simply pointed out a misleading price indication to them, and they will do with that as they see fit. It's nothing to do with me.

In any event, how will I know if and when it's been dealt with, so I can get Tesco to deal with my overcharge problem?

She said that there's nothing she can do now that TS are involved, and that was that.

TS don't care about my overcharge; they only care about any potential criminal activities. I've no doubt I won't even find out if they do anything about the SELs (which are now gone in any event, although I have retained 3 of them).

I know it's only £11-odd, but it's really niggling me now.

What next? Anyone have any ideas?

    TIA

    Sarah

Well, guess what happened to me this morning???

Went into another store this afternoon (about 30 or so miles away from above store) and they were all over me like a cheap suit, was practically followed around the whole store and saw/overheard staff nudging each other saying "yeah thats the one" and that sort of thing, I did have a basket of Fosters (which I was going to R&R ;) ) and went to the basket only checkout, while I was waiting I noticed a few more members of staff standing over at the CS desk and also the manager was standing over with the "security guard" (short greasy type this time) I knew it was the manager as it was him that isssued my R&R on a PSP a couple of weeks ago (after being told to by KK at HO)

Dont go into that store that often so cant think why I got all that attention unless the above store had circulated my detailsA

Going by the distance between the two stores, I would think events in the 2nd store were prob down to the R&R on the PSP, guessing that they were mighty !!!!!! off about it.

I got a console from a store, had to get KK to sort it out, when I went back for my refund I did feel uncomfortable. When I was waiting at CS for the SA to sort out my refund, another SA (who I had not seen when I orig asked for the R&R) walked by me and muttered " oh, they gave it to you then" after I got my refund I went round the store and did a bit of shopping, as i left security guard was straight on walkie talkie, I may be paranoid but felt like he may be relaying the fact that I was leaving. I never intend going back in there as I feel that I will be marked from now on.
Not that I intended going back anyway, when i got the console was the first time in there ever and I intended it to be my last.

Although we have clashed on this thread before I think you genuinely need to be very careful about doing this sort of thing. Because you have received money from Tesco's for goods they have already refunded you on. It could well be seen as fraud.

I hope you did not use a switch or credit card as they will have 'data mining' software that looks for unusual patterns i.e. more than one large refund.

I would do most things, but I would not do what you have done.

And this from someone who openly thinks he is scamming(swindling) Tesco's all the time.....

    Come on......Where's the consistency.....

Ive posted on the Ethics thread for anyone who wishes to continue the discussion.

Its not the first time I've been in there since the PSP though, thats the only thing, I didnt get any attention the past couple of times!

Probably just me being paranoid but it did seem to be a coincidence with this morning events.
    Missing Tesco R&R since Feb '07 :A & now a "Tesco veteran" apparently! ;)

Earlier today I posted a post with regards to a yellow shelf offer label for a £50 reduction of an Acer laptop in my local store - price showed £349.99 with the discount - however the label expired a couple of days ago and so the laptop should now be back to the original price of £399.99. I asked a eleccy guy how much they were and he came back and said that the scanned item was £399.99.

As I am still an R&R virgin, I would like to take the plunge in style :D , would I be likely in succeeding in this ? Does the R&R policy apply to expired dates as it is pretty clear on the label, would I have been expected to know that the offer has expired - this is the area which is causing me the most concern from having a good go for it! As I dont really need a new laptop - if I attempted the R&R, could I get a full unconditional refund if it didnt work out - I wouldnt like to be £349 out of pocket!! :rotfl:

As a final afterthought, if I attempt to pursue this in store and get the inevitable and expected decision that I cannot get the R&R, how do I make a record of the shelf label - in other words what's stopping them from removing it knowing I would take the matter to HO in the morning, would I be right in assuming my evidence would subsequently be gone and any claim with it?

First of all...by asking someone on the electrical section to find out the price for you, may have its problems, as if the guy is in tomorrow, he might offer this evidence, and they may try and get out of the RandR by saying you were deliberately looking for price mis matches.

Having said that...if the out of date SEL is still up tomorrow and you are charged £399, then there really should be no argument, as the lowest price they display, is the highest price they may charge you.

You aren't expected to read the dates on SEL's....I have had 5 refunds today on out of date SEL's with no argument.

If the laptop came through at £349...or £399(and you were refused RandR)...you can return the unopened goods within 28 days for a full refund.

If you are refused an RandR.....don't get a refund straight away...as although not essential...it is better to have the goods in your possession.

Always go with the staff to look at the SEL....that way you have a witness to the overcharge, who will tell someone else at the CS desk....I doubt whether they would both lie about it.

You can also make yourself known to HO about this, ask to phone from in the store...Ive never been refused this yet.

    Hope this helps.

Yep, a banning! .......he said that I am in there "every day" getting refunds (today was only the third time this week)

    IT'S ONLY THURSDAY:T :T :T

I hate to see anyone banned for a mistake made by Tesco, that really is immoral, but I had a giggle when I read that bit!!

Fight 'em, ask for the reason for the ban. Write a pleasant letter to the store manager ask for a reply. If that doesn't work, ask Sir Terry.

Last week when i had an r&r on a mobile the lady said after my refund.."heres your policy leaflet..any problems ring the helpdesk but if you change your mind come in an get a refund or exchange"

so it does make me think if this is fraud if you do get the refund as she clearly said to me I could and she was the one who gave me a full refund 2mins ago!
