Had 2nd hand car for 16 days and its broken down, what are my rights?

    Is that Hartwell who have sent it to Phoenix engines? Phoenix engines not a very apt name for an engine builder "Bursts in to flames then a new Phoenix arises"

    Car needs new engine so they have phoned to say they will be offering me a different vehicle. Am I now in a position to ask for my money back? I might like what they are offering but supposing I dont? Hummmm

    People these days wash, clean and look after the outside of their cars, but they ignore all the warning signs, the odd noises, the smells, everything! They just whack the stereo up and carry on regardless.....

    And this thread shows a prime example of where these mechanically abused cars end up.

    I would see what vehicle they offer you in replacement, the bad car wasn't necessarily their fault. If they have nothing you REALLY want, then push that refund.
    I hope you manage to get a satisfactory outcome from this.

    Unless the car that they offer is exactly to your liking, insist on a full refund, they have admitted liability now.

    Seriously the trouble you have had over this I would consider my options carefully. If you do decide to go for another car I would ask for a commitment from them that if this one becomes faulty a refund of all money paid would be forthcoming.

    You were in that position a few days ago and they have taken the p*ss out of you and you let them by not insisting on a refund sooner.... (sorry that sounds really harsh and I really don't mean it to - just hoping that you will see how much you have been messed around and get tough with them).

    If I were you then i'd most definitely demand a full refund... even if they offer you a car you like, can you trust them again now?

    :mad: OK well ive just got back from Hartwells and what a complete and utter waste of a journey. They had nothing to show me and when I insisted on a refund I was told that the General Manager was on holiday till Monday and no one could authorise a refund except him!!

    Going to search online now for a phone number, address and email address for the head office and see what they have to say.

    11TH OCTOBER PICKED UP CAR
    24TH OCTOBER CAR BROKE DOWN
    25TH OCTOBER CAR IN GARAGE
    5TH NOVEMBER GOT CAR BACK
    22 NOVEMBER PHONED TO GET CAR INTO GARAGE AS WAS A FAULT
    24TH NOVEMBER CAR WENT BACK TO GARAGE


    OWNED THE CAR FOR 44 DAYS

    17 DAYS GARAGE HAS HAD THE CAR

    TOTAL NUMBER OF DAYS IVE HAD THE CAR IN MY POSSESSION 27

  • 1) Complaints concerning sales or after sales


    a. In the first instance telephone the relevant department manager at the dealership; SPOKE TO HIM TODAY HES A WASTE OF SPACE

    b. If they are unable to resolve your complaint, please put your complaint in writing (either by letter or e-mail) to the General Manager of the dealership; HES AWAY TILL MONDAY

    c. The General Manager will respond to your complaint within no more than 7 days;
    d. If you find the General Manager's response to be unsatisfactory, or they do not respond within the given timescales, please send a copy of your original complaint, together with any response you have received from the General Manager, to either:-
    Customer Care, Hartwell plc, Faringdon Road, Cumnor, Oxford, OX2 9RE or customer.care@hartwell.co.uk
    e. Customer Care will respond within no more than 14 days;
    f. We are confident that the above process will resolve your complaint to your satisfaction, but if you do not feel this is the case having exhausted the process, you are of course at liberty to take external advice. Any correspondence from external agencies should be addressed to Customer Care at the above address.
