Hi all, sorry I've not been on for a while, the hearing was simply to confirm an actual court date which wait for it is the 4th Oct which at the time I was devastated about as this meant the existing status quo was going to be a lot longer and in my opinion was in my Ex's favour and that I knew I was only getting to see my son at weekends, not a great feeling.
So time passed slowly, my son went on holiday with me my partner and her kids and had a wonderful time, throughout the summer holidays my son spent out of a possible 51 days a total of 37 days with me. During that time my sons mother went on holiday but didn't fancy taking her son with her!
Anyway the 4th oct is tomorrow but last week a sheriff decided to postpone the case till November as my Ex still has not sorted out her legal aid which I am raging about, and she is simply dragging this out as long as possible.
Well that's the latest am afraid but I still hope and pray things turn out for the best.0 -

Well a week on Tuesday is when the court case is, anxious is not the word, really hope everything goes ok! Just want my son back home where he belongs!
Ex has a pretty thin case but my concern is she no longer works and so can be on hand 24/7 for our son! the status quo with me lasted 5 year, she 'snatched' our son and the status quo at the moment is 8 month, however is a judge going to change it back to the former? i truly hope so.
I am honestly dreading it! i just thought i put a post up here for your thoughts?0 -

do you have a solicitor, do they know everything and have it recorded? My brother is the custodial parent, he has been going through the courts in Scotland regarding access, and soon residency (again) for the last 3 years. Its hard on everyone concerned, you have my sympathy, stay as calm as possible and I hope the outcome is whats best for your son.0 -

IMO the legal system is poor, my solicitor is confident, i have a very strong case compared to my Ex's, the biggest concern is the length of the status quo now,(since February)
her solicitor is 'surprised' i'm still pressing ahead with residency as he doesnt think 'any judge' will change the existing status quo, even though the intial one was for 5 year!
The other thing i think will go in her favour is that she is not working and can be on hand 24/7 for our son. Fingers crossed though, thanks for all your kind words.0
