    She wasn't behind me, so she must have been behind the car that was... She could even have been two cars back.

    She assumed both sides of the road had parked cars, she was not paying attention and she was not considering the road conditions.




    AND of course you going to see her in the rear view mirror as she hits me car, your viewing from the passengers side and the flash is when she's next to my drivers door!

    You know...... My car has been damaged because some silly old bint who should even be driving, has tried to (knowingly or not) squeeze past a queue of cars at a junction. Her recollection of events is entirely wrong and she claims to have been in the queue when she was in fact overtaking it.....


    Oh, the car coming the other way.... He should have waited, if your side of the road is obstructed by parked cars you MUST give way.

    judging by your video, and looking for you in the mirror as you pulled off i did not see you check your blind spot if you had you would of seen this vehicle, the mirror is pointing at your window so if you had checked you blind spot we'd see you looking through the window to the rear. 3 seconds after your collision you then look out of your window to the right. 1:38 in the vid. i would say that you are to blame as yes you checked 4 seconds before pulling off but did not do a final check! your at fault!!

    in the eyes of the insurers she did not drive into collision with you. you drove into collision with her evident from your video, you also failed to check your blind spot. many drivers make the assumption that waiting cars are parked, you had a vehicle behind you to obscure her view of you and your indication (if any), to her the road ahead was clear, and you were a mere parked car and the one behind you,you then pull off into collision with her, im affraid if i was a insurer and looking at that footage i'd find you to blame!

    Sorry, but you're just digging deeper now.
    You say she assumed you were parked, and wasn't paying attention, but then you say you don't know where she was, and assume she was a few cars behind, and not considering the road conditions, and then you did exactly the same, tried to overtake a car you assumed was parked that then moved off.

    Sorry but I agree with the above. To me you are at fault. Why didnt you check your mirrors before you pulled out?

    That gets my vote to. The video driver should have checked behind before pulling back out. At best it's 50:50, but I certainly would'nt hold the other driver 100% to blame.

    sounds to me you dont know where she was before she made her manouver, opinions do not matter to insurers youve proved that you pulled out into her youll be found at fault. insurance dont do woulda shoulda coulda, they will only see what is in the vid.

    Even deeper.

    That video clearly shows all the queueing cars, there weren't any in your first one.
    No way would your view in the mirror be blocked by the car behind, you can see from your second video it's a straight road, with a good view.
    If she can negotiate that road at 35mph, she's a better driver than anyone else that has to weave through slowly.

    In an incident where a car is overtaking another car and a collision occurs, who's fault is it?
    Would you overtake a car that was indicating right? I would hope not!

    That is exactly what this boils down to, the highway code clearly states that you should not overtake unless it's safe to do so. She shouldn't have been driving down the middle of the road in the first place.

    sorry but you were static only one vehicle behind you and one infront her interpretation of that situation is that she though you were parked! the traffic in that film is moving whilst you were not given the factors you had a vehicle behind you obscuring her view of you, and he may not have been indicating at the time or had his foot on brake to show rear lights she may have assumed you were both parked and over took as per normal.

    General rules (159-161)
    159



    Before moving off you should
    • use all mirrors to check the road is clear
    • look round to check the blind spots (the areas you are unable to see in the mirrors)
    • signal if necessary before moving out
    • look round for a final check
    Move off only when it is safe to do so.


    (And you were overtaking the car in front, but I'm sure you're quoting to mean her overtaking you)
