Opinions, accident video.....

Having some issue's with the insurance company, they don't seem to care much for actually watching this video.... While I think, having seen the 3rd parties description, this video proves she was not paying any attention to the road whatsoever!

  • Going off a written/verbal description of this accident then I'd probably say the driver of the parked car (with the camera) was to blame.




    But after watching the vid and reading the road ahead then I'd lay blame with the light blue car.

    You can usually tell when a car is parked by its road positioning! It's trickey though, beacuse if you were parked, she's have an argument! An elderly lady pulled out of a road and hit my wife's car a while ago. My wife was travelling normally down a hill and this woman drove stright in to the side of my wife's car, causing her own car to roll. Said woman still didn't admit it was her fault!

    You weren't on your phone at the beginning of that drive were you? ;)

    Did you send them the raw video or the one with all the comments on?
    tbh, you look like you park up, then pull out as she overtakes you, so I'd say you were at fault for not checking the mirrors, as you were stopped for quite a while, with nothing coming the other way.

    (From your original posting a few months ago, I did say the opposite though)

    I sent raw video with comments on separate frames, an edited video would not have been accepted.

    Id stopped for around 6 seconds, waiting in a queue....... The annotations make the pause seem longer, but I was not parked and I think that's quite clear from the fact that id only just gotten into my car anyway!

    That's what you said originally, but I can't see a queue, just the car parked in front. Nothing in front of that from the shadows, then you pull over behind it, with nothing coming the other way. Seems fair to pass you. Maybe you stopped to read the map, or get a cd, the fact you just pulled off doesn't really matter.

    ^^ What you need to view is the point before stopping, there was a queue ahead (yes i know the video quality is poor). The thing with that road is you have to pull to the left in order to prevent traffic backing up onto the main road in the other direction.
    It's also very common for people to mount the kerb on the left while they queue here, I sent video's of this from the following 2 days along with this video.

    If he's clearly in the road (ie; about a foot from the curb) and he had his foot on the brake (not strictly ahearing to the HC, but we all do it when only stopped in traffic during daylight hours!), it should have been blatantly obviousl that he was only stopped in traffic, not to mention parking there was probably illegal anyway, and he had no indicator on!

    The original description from a few months ago paints a different picture from the interpretation of the video.
    I'm not taking sides here, just trying to see what the insurance company could be seeing.

    ^^ To clear this up, im but a few inches from the kerbside, foot on brakes.... You have to be on this road or you'll loose a wing mirror :(

    I know you cant see any of that, but if anything can discredit the other driver?
