I think the problem is, there is no traffic coming the other way, and you have an accident doing exactly what the women is doing, pulling out to overtake a "parked" car in front, that you then claim is queueing. If it's parked, you did exactly what the woman was doing, if it's queued, (like you) you shouldn't have overtaken. Catch 22 really.
You'll be lucky if it's 50/50, rather than your fault.0 -
I know you cant see any of that, but if anything can discredit the other driver?
She discredits herself by claiming the road was narrower than it was, by claiming I was parked and claiming she was in a queue and by claiming that I was atleast half way on to the kerb showing no lights or indications.
ALL this despite the fact that she was less than 6 seconds behind me and would have seen me stop in the queue if she'd been paying attention!

tbh, you look like you park up, then pull out as she overtakes you, so I'd say you were at fault for not checking the mirrors, as you were stopped for quite a while, with nothing coming the other way.
(From your original posting a few months ago, I did say the opposite though)

Did you see the third party in your mirror before you changed position?
If you answer no to either, or both of these questions then you have no argument to be honest and it'll be 50/50 at best.0 -
Hows the insurance company viewing it? Your fault? or 50/50?

She was behind the car that was behind me, both myself and the other car stopped, but she pulled out from behind that car doing 35/40mph.
I checked the mirrors, I indicated for the benefit of the cars infront, but my vision of her was blocked by the car behind me.
Indication was almost as soon as id stopped...... So she's overtaken a car approaching a junction on a single carriageway, which was not parked and was indicating right from the moment it stopped.

I don't think it needs more videos.
Just because you indicate, (which you can never prove), it doesn't give you a right to pull out. If you can't see a car overtaking the car behind, then overtaking you, and then you pull into it as it passes you, where was the car behind parked to block your view of it, as I can't envisage any way the view could be blocked unless the car behind was fully blocking the road as well.
How did she pull out at 35 to 40 mph, if she was queued as well.

The blue car is passing you as you pull out. You fail to keep checking your mirrors as you pull out and actually cause the collision. The blue car was actually passing you before the collision. You pulled out into it.
Oh and you were wrong about that car coming the other way that "should have given way". You didn't have right of way; no-one did.0 -

How do you know she was behind the car that was behind you? Did you see the blue car there? If so, how were you not aware of it's attempt to pass you?
Unless you mean that she had stopped behind that car (yellow one?) and then pulled out to pass you both after having initially stopped?0 -

I knew there was something in the video that I couldn't put my finger on, it's the mirror. You're right, the car is visible before the impact, just as the op tries to move out.0
