Zippy would just like to point out you are wrong on this, they have the power to Detain you and that is not false arrest, they are detaining you until such time as say the police can arrive to arrest you. It is not assault unless they do not specifically tell you that they are detaining you until the police pitch up.
As for the OP not going with the security guard, I dont blame her, she is well within her rights to ask for a manager to be present or even another staff member or even a random member of the public. The security guard dealt with her in the completely wrong manner, and needs to be re-educated as to how to deal with people.
Hopefully OP has all this sorted out satisfactorily and that there is some kind of compensation heading her way and her daughters.
Only if they specifically witness you taking something. The alarm in itself is not enough. Security guards have no more rights than any other member of the public.0 -
The security guard is being authoritarian and is not allowed to even talk to you in a threatening manner, so you feel verbally assualted.
Also I suggest you write a letter to [EMAIL="TerryLeahy@Tesco.com"]TerryLeahy@Tesco.com[/EMAIL] and inform him of your experience and finally video everything whilst interacting with the staff from now on, you could use your mobile phone or a nokia bluetooth camera which can rest on your headgear.

Left the store only for the alarm to diacitative - everyone looking around and the security guard shoots from his desk, grabs my trolley and asks me to accompy him as the alarms went off. I refused to go with him as he was male and I was more shocked, I asked for the manager he refused, .......
.........its embarrasing, yes I was innoncent, I had nothing to hide, but its the way its done.
I can understand how you must have felt, it can be embarrassing and nerve racking even although you know you haven't done anything wrong.
But I do think you reacted badly and caused this to be worse that it had to be. You said you didn't want the security guard because he was male, what would you have done if the manager had come and he was male too? You were asked to go to a quiet place, you refused. You didn't like the unerwear being seen. Your logic just isn't sensible, I think you were just being overly emotional about it all tbh. The security guard was doing his job imo, but the checkout chap wasn't. It would be his attitude I'd be complaining about.Herman - MP for all!0 -

I refused to go with the security guard, I will hold my hands up to that, it was to do with his attitude and how he conducted himself, I felt unsafe and was not going to put myself into a situaution that I was going to be uncomfortable with. I asked for a manager as I wanted a witness, wouldn't of bothered me if it was a female or male manager, even with a manager there i would of stuck to my guns, I was correct, it was the cashier who was at fault regarding the tag not being removed, but the attitude of the security guard was an issue.xx rip dad... we had our ups and downs but we’re always be family xx0 -
What a surprise a letter of apology, basicaly exaclty what was said on the phone, the impression I get is lets keep it at store level. Yes the cashier gets retrained, but that doesn't cover the fact that of how I was approached or shuld I say my trolley pounced on.
