    My OH has to works for a haulage company & must buy his own steel toe cap boots & gloves as well as wash his own uniform. He gets a net amount in his wages & when the tax code changed in April this year, his employer adjusted his gross pay to ensure that his net pay stayed exactly the same, so we got no benefit from the increased tax code. If he claims for this for the last 6 yrs & he gets the relief through his tax code will the tax office notify us of the new code, so as we can tell the employer not to make any changes to his gross pay, or is it illegal for him to not pass on the change in tax code.

    This depends on individual circumstances, but in principle your partner has a business based at the address where he lives, so as soon as he gets into his car with his tools, then he is trying to make a profit for his business. His self employment would be more convincing if he went to work in a sign written van.
    However the construction industry is heavily scrutinised by HMRC because of its history of "the lump" and your partner might be caught up in the Construction Industry Scheme (CIS) which forces building workers to reclaim a tax similar to PAYE.
    HMRC has an example on its web site of a self employed milkman, who does all his paperwork at home BUT has to park the milk float in the dairy overnight - so cannot claim his "commuting" journey.

    There are several threads on here, including a wife fighting for a rebate for her chippy husband (she won eventually).

    It would be best to search for these threads, then start a new thread explaining your partner's personal work pattern.

    Hi ...i have just been made redundant from my company after 7 years and 11 years with another company ..I had a company uniforms with company logos with both companies...can I still claim this as I always washed my uniform at home, we were never told about this benefit .....
  • Hi I work for a small company that requires me to where t-shirts and jackets with the company logo on. Would I qualify for this rebate and if I do where does the money come from? Will my boss find out and will he have to pay anything?

    Hi missladyannie, I applied on behalf of my husband on 12th October and he got a rebate for the past 6 years of £597.45 - plus this years tax code has been altered to take this allowance into account. Got one cheque yesterday and the rest to come. The letter says my husbands union has agreed with HMRC the amount he receives. We are absolutely delighted. :j Many thanks to the moneysavingexpert weekly email for alerting me to this. No one at work ever said he is entitled to anything like this.

    When I claimed years ago HMRC sent a letter to my employer asking to confirm wearing my own work clothes. So yes, they will find out.
  • Both me and the Mrs got cheques today (mine was £150 ish and hers for £84), both stating for the tax year 2010-2011. Does this mean other cheques will for for the other years claimed?, or is it best to ring them up / write to them again?

  • I applied for this a few weeks ago and have received letters saying I have been awarded a flat rate of £60 a year and have been back dated £174.27 for the previous 5 years. Just like to mention if your uniform doesn't have a logo still give it a try. Mine doesn't I have to wear a basic white polo shirts and black Trousers and black shoes. but this is not worn outside of work, but exclusively at work and required to wear by my employer. And I still was able to get it.
    Happiness is not having what you want...but wanting what you have!!!
