Myvesta sent me an email requesting questions that I would put to an OR. You may have had this email yourself if you are registered with Myvesta.
Apparently they are filming some new videos this week!
I have submitted some questions already. We have until Monday!
If you have any questions you would ask of an OR then tell me and I will send them in!
They want specific questions, not just "What does the work of an OR involve".0 -
I have a big problem! Re two claims. I sent an email to one of the website's posters whom is an OR themselves and was told NOT to go bankrupt under any circumstances. Oh what a mess! They advised me to send an email to the official insolvency service website for clarification on the matter.
So, I have sent an email to the official insolvency service, as below, to see if someone can tell me anything!
Dear Sir/Madam,
I am desperate to seek debt relief and am considering bankruptcy - Individual Petitioner Bankruptcy.
The case is complicated and I am desperate for some accurate advice.
I have a medical negligence claim ongoing pertaining to a problem September 2000. Should end by January 2009 if I am lucky. This will be for Compensation only.
I have a Breach of Employment claim ensuing, which started in August 2006, which will take a similar length of time. This will be part compensation/part loss of earnings.
Because of my disability and being unable to work at my first profession, I was teaching as a second profession in order to keep working, which has now been stopped because of my Employer breaking the law with regard to Breach of Employment Contract.
These two episodes put together have left me in the position of living on Incapacity Benefit and Income Support(not yet assigned to me) of £85.20 per week and of having no money with which to pay an IVA and having to consider bankruptcy.
Considering that the amount of payment due will be considerable, although my solicitor has not made any suggestions yet. My debts are at £52000. I am unable to take an IVA because of living on State Benefits.
My questions are as follows:
1. If I proceed with bankruptcy am I still allowed to pursue my own claims on these two cases?
2. Must these claims be disclosed to the OR?
3. Once the two claims have been paid to me I will be out of bankruptcy and I will not have had an IPA. Will I then pay a proportion of the monies to the OR?
I have had differing lay advice from debt management companies, and online debt forums.
I really do need some clarity on this please, if someone can advise. I would be most grateful for some help.

Sounds very complicated Sandra - I don't know if you have tried the Insolvency Helpline (as opposed to Insolvency Service) at https://www.insolvencyhelpline.co.uk - they have an email service.
I asked my OR about the possibility of pursuing my claim against HMRC - the creditor that made me br, and she told me that this would be up to my trustee.I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.
If any of my experiences, or the knowledge that I have gained from those experiences, can help anyone who finds themselves in similar circumstances, then my experiences have not been in vain.

If you could pursue the claim after your discharge surely there shouldn't be a problem?

Im hoping to be allowed to keep my BMW 316i (M3 replica) as its now only worth £800 (1994 m plate) also need it to do the 25 mile round trip to pick up the kids from schoolOfficial DFW NERD 189

Ive used them too.. They are very good.
