    Thanks Richard

The thing that worries us most is that if the Ltd company doesn't pay, that they will then charge my MIL for the business rates instead. Though I suppose that way we don't pay bailiff fees and can pay her somehow.

Have been trying to ring the Business Debtline for two weeks now - can never get through and desperately need some professional advice so we know what to do - knowing me I'll get it wrong somehow and end up with more debt - or worse (prison?). I know it's silly to get this scared of it all, but sometimes we just cannot help that - and no way am I increasing the anti-depressants!

I just keep trying to think that in a year it will all be sorted somehow and then we can have a life - we've been working so hard to get this sorted, only for it to get worse.

Perhaps I'd best stick to knitting!

    Hi dabble,

Just a couple of questions that might help you resolve the Rates problem:

    1. Do you have a formal lease between the Ltd Co and your MIL?
    2. Did the original Rate Demands come in the name of the Ltd Co?
    3. Did the Ltd Co actually make any payments to the Council before you ceased trading?

I've got a Non-Domestc Rates battle going on at the moment and I'll post that when it's resolved; on the plus side it's given me something of an insight into the "psyche" of the Council predators. One conclusion I can draw at this point is that they were more than happy to commence proceeding against me personally when in fact I'm not liable (fingers crossed)

    Richard

P.S: You're right to keep telling yourself that you'll get over your current problems; you will and when you look back you'll think "why did I worry so much;" be kind to yourself and don't worry so much now.

Thanks Richard - it's helpful to have someone to talk to about it. Going to ring the National Debtine later too (after kids' bedtime) - at least I can say I've referred to professional advisers then.

To answer your questions - and am happy to keep it here in case it is ever helpful for someone else - I appreciate you're not a prof adviser, but it seems you've been there and done a good deal of that... :-)

    1. Do you have a formal lease between the Ltd Co and your MIL? No but there could be one
    2. Did the original Rate Demands come in the name of the Ltd Co? Yes
    3. Did the Ltd Co actually make any payments to the Council before you ceased trading? Yes - we did make the first payment, and have forwarded this all to our home address - they know the Ltd company is liable.

    Thank you

    Hi dabble,

I'm not a professional and I wouldn't dream of saying something that I wasn't certain was factual, I would be devastated if somebody based their actions on what I'd said and got themselves into trouble.

So I'll qualify this statement, "In my opinion" if the Demands are in the Ltd Co's name and the Co did make payments then if I was in your position I'd concentrate on convincing the council that the Ltd Co is the body responsible for the debt and hope that they take winding up procedures against the company. I'd protest loudly that your MIL and you personally are not responsible for these debts.

Good look with the National Debtline.
