    Well done, you're a fully fledged member now :T

    I feel as though we missed out cos we didn't petition for our bky and didn't have to go to court, well we could have gone but chose to keep our heads down.

    werent quite sure he was gonna go through with it this morning! especially after we had been waiting half hr for the bailiff! (kept saying if they don't come in a min Im going but thankfully he didn't! )
    Though he did say on the way home I hope this OR aint gonna ask me loads cos I can't be doing with being questioned for and hour! so lets hope they will speak to me ! Ill try and give as much detail as I can when they send the questionaire then perhaps they wont want too much info on the phone! but its done now! and I for one of the two am relieved!
    (at least now if he leaves or I chuck him out I wont be saddled with his debt again or feel guilty I got him into debt! LOL)
    still I feel much better than I did last night or this morning I might even have something to eat now!

    Hi Angie,

    I don't know if there are any official guidelines but from speaking to people on this thread I get the feeling that the interviews are more in-depth if your bky is the result of third party action as opposed to petitioning for yr own.

    Could be that they have to be more certain that they have uncovered everything when they know that they'll have to report to a creditior whose spent a hefty four figure sum and isn't going to be very happy if they don't see any return for their cash.

    Oh help.

    Apart from my OH and me going to go BR as soon as we can, I need to stop my Ltd company. One of the debts is for this year's business rates (was renting small office from my MIL) - having had an accident early last summer, that dropped off the radar - anyway - we emptied the office, meantime my Ltd company was taken to court - we knew nothing of this until a bailiff turned up at my MIL's house demanding payment. That was embarrassing. We have since got the council to review the amount due, with the office being empty, and now had a revised bill, but they say I have to sort this with the bailiff (read, pay several hundred pounds more than should have to). And I am terrified, which I know is stupid, but I am. Sitting here in the gloom with curtains closed - ridiculous. I cannot pay the £1016 due - but am sure that if I don't pay it due to the Ltd company going under (not sure how to make that happen with limited money to pay for it) they'll go after the business rates for this year from my MIL - and I don't want that. Anyone have any ideas on this? What I would offer the council is three payments to clear the debt before the end of this rates year (surely that would be reasonable).

    Any ideas or experiences welcomed.

    Also any suggestions on how to dissolve the Ltd company - main debt is to bank for £20k - they will then come after me as I'd personally guaranteed it (reckon they've had this covered a good deal by charges) - must time that right and dissolve Ltd company first, I guess.

    Oh dear - I so want this sorted out now. Going to do some major ebaying this week so that we can pay the BR fees for us both.

    Hi Dabble,

    Are you sure that the summons for the rates is in the Ltd Co name because if it is then it should just be a case of phoning the Council to inform them that the Co is no longer trading, has no assets to realise and then let them do whatever they will. If they apply for a winding up order against the company then that will save you from having to do anything.

    You can have the company placed into receivership or liquidation yourself but that’ll not be cheap. I think a rule of thumb for an insolvency practitioner is that they won’t touch a small Ltd Co if there’s less than £5k of realisable assets. The other alternative is to apply to Companies House to have the company struck off (I think it’s Form 652A) and this only costs £10. The problem is that you have to send a copy of the form to every organisation that had any dealings with the Co and anyone of them can object to the “Striking Off” Order; although why would they if there are no assets?

    You really need some specialised advice on yr options and there is a sister organisation to the National Debt Line that deals with small business problems. If anything else occurs to me I’ll post later on otherwise fell free to PM me.

    quick trot downstairs wait for 15mins while she types up something, says she ll fax it all through to the OR we should recieve something in the post soon. would you like a leaflet on what happens when OR calls. thank you goodbye (nice smiley lady)
    (she even gonna put on the fax that perhaps they could speak to me as OH will be at work and it will be hard for him to speak! but that is upto them? so he might have to do something else yet)

    The thing that worries us most is that if the Ltd company doesn't pay, that they will then charge my MIL for the business rates instead. Though I suppose that way we don't pay bailiff fees and can pay her somehow.

    Have been trying to ring the Business Debtline for two weeks now - can never get through and desperately need some professional advice so we know what to do - knowing me I'll get it wrong somehow and end up with more debt - or worse (prison?). I know it's silly to get this scared of it all, but sometimes we just cannot help that - and no way am I increasing the anti-depressants!

    I just keep trying to think that in a year it will all be sorted somehow and then we can have a life - we've been working so hard to get this sorted, only for it to get worse.

    Perhaps I'd best stick to knitting!
