If you acquired a car after the bankruptcy order you wuld have to write to your OR and inform them, as with all assets you come into after bankruptcy but before discharge, its called after acquired property. The OR would have 42 days to claim it, if they dont claim it you keep it. Whether it is claimed would depend on the value of the car. It would be better if someone else bought the car and just let you have use of it.
When considering what you should repay, if anything, savings are not allowable as outgoings. But you should be left with some money todo what you want with: eg if income £2000 and reasonable essential outgoings £1500, surplus £500 and IPA of £300 approx would be sought, leaving you with around £200 to do what you want with. These figures stated are not accurate: they take betweeen 33% and 77% of the surplus i think, the biggrer the surplus the more is taken.fabianne wrote:Thanks Charlotte

I have spoken to and got good advice from the debt advisors with CCCS and National Debt line and the business debt line.Once I had been through the whole thing-they all suggested BR to me-it is my donkey feet that is stopping me.
I also mentioned my options to my Mum-and she freaked out-think she is more worried about it being in the local paper,so I may not tell her if I go ahead as she is one of the 'what will the neighbours say?' brigade-and I am concerned too as I would hate my ex husband to gloat over it if he saw it.I also worry about if my clients will see it and judge/quizz me.
My car would have to be given back (can't afford it anyway) BUT if I got an old banger-would that be ok?Or if I can't afford one at present-are you allowed to save to buy one in the future? Part of my business is freelance and I would need to get to my clients you see.
Are you allowed to start savings for University fees etc for the kids??0 -

(so annoying !)

Maybe try a couple of bottles to help you sleep, oh we remember the days fondly when we could afford to spend more than £3 on a bottle of wine without having to justify it to the O.R; ok we admit it, the stress has turned us both into alcoholics :rotfl: .

how long from filing online forms in do you br
how is it in the court room does everyone look at you and you know look down on you

I think it i s a min £750 in debt to go B - someone may correct me on that...
Costs £475 - Less if you are on benefits
You have to make an appt with your local court, complete the forms at your own leisure and submit them the day before you go to court.
The court is usually a busy place, lots and lots of people there doing different things, they all have their own problems i there to be interested in ours.
Judge doesnt tell you off at all, most are very nice. Make sure you et the professional advice mind.
Paper simply says you are B, date and address... Its usually in the Legal and public info section. Mine wa snever noticed by anyone !
