Afternoon guys,
well got the nice batch of forms from the OR today my telephone interview will be on the 24th nov at 2.30.pm
the time scale has shocked me a tad as in it will have been 3 weeks since court .
Gooner chill out hunni you have your holiday and make sure you enjoy it and have a few drinkies for us ! we went away too just b4 my bankruptcy and nothing was said.
gonna haft to ring the OR as alot of te paperwork they want i do not have .Official DFW NERD 189

Hi,
I hope Im on the right thread but feel free to move if not.
Im asking this question on behalf of my very worried mother. She & my Father separated over 18 years ago but have only got round to getting divorced now ( dont ask)
Anyway my Dad is Self Employed and owes the Taxman a rather large amount and is considering bankruptcy. I've just told my mom this and she's worried that the courts will want a share of her own house as the divorce isn't finalised.
Could anyone let me know if she's safe or not?

awww! thanks you lot making me feel bit better about it ! still don't stop the guilt though

think i gonna have a cuppa to chill with and maybe a choccy biccy! can't wait for BR to be over then I can save for my Tassimo machine so I can have a cappucino! LOL

Hi - I think that you may need some legal clarification on this point. Is the house still the subject of a mortgage - in which case is the mortgage in joint names?
Was the house part of a 'separation' agreement and would it have formed part of the divorce settlement?
I think that, if your dad just 'gifts' his equity in the house to your mum now, then the OR may be suspicious. I assume that your dad has a different address, but he will still be asked if he has any interest in any other properties.
How imminent is his decision to petition for bankruptcy?I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.
If any of my experiences, or the knowledge that I have gained from those experiences, can help anyone who finds themselves in similar circumstances, then my experiences have not been in vain.

Im also thinking there is a 2/5 year think in which if you transfer property the OR can still look at it ? I may be wrong on this.. But its what I have kind of understood from the forms I got... They are going to chase the brewery for part of the money they got for my lease on the pub even though I gave it to the brewery for nothing ! (doh !)0 -
AND Im in the middle of tiling my kitchen... (sexy black tiles !) and have got tiling adhesive all over my keyboard now.... whos fault is that !0

The house was brought 8 years ago by my mom and her partner so my Dad has no interest in the property.If you like it, do it.

Only any joint financial interests will be investigated by the OR, but, as I found out yesterday, he will not be interested in your mum's affairs.
