Business Account - reclaiming bank charges

I hold an business account with Lloyds tsb and have gone through all lines of inquiry up to the stage of threatening legal action to take them to the small claims court. I have recently received a letter back stating that they will not pay what is due to us as we hold a business bank account. They referred to the unfair contracts terms act 1977 and also the unfair terms in consumer contracts regulations and they told me that they do not apply to business customers.
Is this true or do I have the same rights as a personal current account holder? I am thinking that this is just a clever stalling tactic to stop us from persuing it further.
If anyone could help me, I would be most grateful to hear from you.

Hi Pauline,
Yes, you can claim for business account charges, the same as for personal accounts. I've won my case against Alliance & Leicester for £2307 + interest + court fees, primarily because the bank didn't get its intention to defend to the court in time. Just waiting for the bailiffs to get my money now.0 -

As a freelance bookkeeper I have several clients who have suffered punitive charges over the years. Is it worthwhile trying to get these back or do the banks view Business accounts differently? Is there more in the small print when you open a Business account to protect the banks?

Hiya everyone , my hubby is claiming from an hsbc business account for his money back what they took off him when he had a business (its now closed) .
I got really fed up today about it you can not phone the department which is dealing with hsbc business account , so i did some detective work and found out thier phone number and it actually goes straight to the horses mouth ie Jhonathon Cuff at commercial core products hsbc . if anyone wants the phone number let me know on here and i will let you all know.
My hubby spoke to the man himself today and he only upped the offer by a little bit and seemed very surprised that a customer had actually phoned him lol but my hubby said no thankyou to the offer and we would be taking it to court .0 -

I am a sole trader and my bank has slammed me with £700 of charges for returning payments in the last 4 months (FOUR!!) alone. This has obviously compounded problems for us, and what was once a steady business making ends meet is now an ailing company at a tipping point. Can I strike back? Is it worth appealing to the banks good nature <ahem>? I have been with them for 17 years personally and am claiming my private charges. Should I wait for this to be resolved before challenging them on my business account?0

Having got £1988 back from HSBC for my daughter and am awaiting my claim with HSBC to be settled am now moving on to my ex's business account, its been closed for 18 months, the charges on the statements come including normal business account charges, do i need to knock these charges off first or do i bang in the full amount and let them sort it out, its HSBC again.

Hi I dont know if I will get anywhere with this but my husband has been with TSB for 25years+ and has had a business account with them for most of that. He has an agreed overdraft of £1000 but seldom uses it. Every year it gets re-newed. Again this year a lady rang and asked if it was to be re-newed and we said yes, its a safety net, and we have been charged £100 arrangement fee. Is this a lot?, we dont seem to have paid this much in the past? and it was for just a phone call?1?!?!? should we tell them to cancel it? he hasnt been overdrawn for years!!0

Compared to my OH fee for the same on his business account I think it is a percentage of the overdraft allowance. As it is technically a service fee I dont think its reclaimable but you can try to cancel the overdraft and ask for a refund in proportion to however long the yearly service had left to run.0
