I have recently started a claim with Lloyds TSB, and they have replied with a polite letter explaining that they will not refund the charges as we have a Business Bank account. They have stated that the Unfair Contracts Terms Act 1977 does not apply to business customers. Does anyone know if this is correct, or is this their way of fobbing me off?0

I have been using Martins template letters to claim £1500 of bank charges in my partnership business. I have received a letter back from the bank advising me that the bank cannot refund any of my charges and that the Unfair Contracts Terms Act 1977 and the Unfair Terms in Consumer Contract Regulations don't apply as we are a business consumer.
Surely we are still a consumer whether we are a business or not and we are entitled to a refund like any other bank customer.
I will now send of the next template letter re. court....

Hi,
I have followed your letters and tried to claim back interest on a business partnership account. We are not a limited company and the impression I got is that these claims would be dealt with in the same way as individuals.
However, the responce I received from the bank stated "You have highlighted the Unfair Termsna in Consumer Contracts Regulations 1999. These do not apply to business customers as they are not consumers for the purposes of the regulations."
Should I proceed and send the standard letter for not getting a satisfactory responce or give up now.

I am new to this forum and just needed some advice please.
I am currently helping my mum claim back her business bank charges and her banks solicitors requested that they would strike the claim out as she isnt the named account holder of the business account. Which she is as its her company. I originally spoke with the courts and was told that they were stalling and that she could claim in her name or the business name it didnt matter however they wrote back telling her that they had requested a strike. So to save hassle she changed the claim from her name to her 'name on behalf of the company name'. Now the amount she is claiming is quite a lot and she is concerned that she is going to loose the claim as the judge has ordered a hearing for this strike in August, even though she has now changed the name to what the solicitors wanted her to change it too.
Has anyone got any advice off what we need to do, should we get solicitors involved so I dont !!!! this up for her or are we ok with this hearing.

The letters for business accounts do vary a little so as not to mention the acts that do not apply, there is a thread here somewhere that I have read and gives excellent templates
If you do a thread search for 'business account' you should find it
It is possible i have read it on the CAG site so try there as well
If anyone else knows better i am sure they will post

Can you advise if business partnerships can reclaim their bank charges and if so under what legislation in Scotland. The bank say get naffed as not covered under ;consumer rules. Do we take them to the smal claims court etc or what?

If you own a business can you claim bank charges back if the bank has charged you for being overdrawn? This is Yorkshire bank and by the time you realise that a direct debit or a cheque has not gone through they have charged you £35.00 and then another £35.00 and it goes on. Usually a letter arrives a week later and because they have charged too much there is something else not been paid.0

Yes you can, but the rules are slightly different, Please read the reclaim charges help thread at the top of page one.Hamsters have no tact and diplomacy, nor do they want any.0

I have received a letter from my bank today and it's plainly obvious they are trying to get out of it.I've used the template letters on this site and in one it refers to the Unfair Contracts Terms Act 1977 and the Unfair Terms in Consumer Contracts Regulations.
My bank states ' but these don't apply to you as you're a business customer and these act and regulations only apply to consumers'
I am self employed and a sole trader.
Am I fighting a losing battle or shall I continue and threaten to take it to court0
