    I know for a fact that when you go to apply for the refund on penalty charges on a BUSINESS account you CANNOT use the Consumer Credit act. I suspect that perhaps you did mention the Consumer Credit Act in your first letter with regards to your claim on the BUSINESS bank so the bank are right in what they say. BUT dont be put off! It only requires a few changes in the wording of the letter!
    I have claimed successful on our BUSINESS account against the Northern Bank.
    I think you should read this forum (Business Claims......basic guide)..which was so very helpful to me. It has all the templates letters etc you will need.

    Can anyone help me.. im going after barclays for my private acc and my business acc, but what charges can i claim back on the business acc, i cant find out anywhere.
    On my statements the bank have sent there are commision charges up to £425 a month, can i claim these as well as the normal ones as these would included overdraft fees.
    what do i do...:confused: thanks in advance x:

    hi there, I am very new to all this but have started making my claims against Bank of Scotland and Barclays. BOS have told me to get lost as there is nothing more to discuss. My account with them was a business account and as far as they are concerned recent media coverage of bank refunds under `Unfair Terms of Consumer Contracts Act relates to credit card charges only and not business customers. I responded with a letter stating i was claiming repayment of charges because their actions were unlawful at Common Law and contrary to Statute. They have continued to tell me to get lost... so I gather from the forum .... i have to go via the courts.... can anyone give any advice bearing in mind its a business account and i`m claiming £9724.45. Should i submit several claims to keep the figure under £5000.? thanks for any help

    PLEASE HELP ME, im on step 2 but with my business acc i dont know what to claim for. can i claim the commissions charges as these no dought contain the overdraft charges aswell. im really struggling here and cant get any answers .
    Because it is not broken down on a business statement im lost.

    I am in the process of claiming from the BOS on a business account. I have wrote my 2nd letter, asking for repayment and as yet have had no reply. I live in Scotland, where the small claims limit is £750 and my charges total approx. £4000, so I will be going through the FOS. I asked them for advise and you can claim for a business account, it is no different from a personal account, so they had better not tell me to get lost!!

    I didn't use those letters, but adapted the ones on this site for personal accounts and I've won my case against Alliance & Leicester. Just waiting for the bailiffs to get me my money now.
  • i have been told by lloyds tsb that as i am a business account holder i am not covered by consumer contracts regulations. is this true? also they have told me that the money that i`m claiming for was for dealing with my requests to go over my overdraft limit,but all that i`m claiming for are unauthorised borrowing fees and unpaid cheque fees. are they plying a game or have they misunderstood? or am i not covered?
    please help?
  • As a freelance bookkeeper I have several clients who have suffered punitive charges over the years. Is it worthwhile trying to get these back or do the banks view Business accounts differently? Is there more in the small print when you open a Business account to protect the banks?
