hi all, still heard nothing from anyone about the house and benefits ect. i went to housing benefit aswell today to see if i can claim the rent on this house. ive been told at the moment i could only claim for myself enough for a bedsit in my area as i cant prove the children are living with me and i need to be on a benefit or provide bank statements to prove i have no income and a tenancy agreement which i dont have and cant get hold of one as its in exs name. the homeless centre said i need to be actully homeless before they could act so no help there either. it looks like its going to be a hard few months from now on
im going to look at all the info that everyones kindly posted now
    thanks everyone

ive been in this situation kind of. i split with the mum of my children weeks ago allthough i'm still friends with her and see the kids.

i relinqiushed all benefits so she had a passport to claiming.

child benefit messed up income support did also.

all i can say is that you need to get hold of your MP's office. you need to make a self refural to social services and ask for help under section 17.
you will be provided a social worker who then can call benefits especially child ben to tell them you are single. you need to get a claim form asap and send this form off regardless if he claims for your kids at the end of the day he will be overpaid not you. if you have access to the internet gon on the hmrc websit fill in an online claim form or pdf printable form. make appointment with MP asap they have hotlines to childbenefit manager and income support, they will get down to the bottom of your problems and advise you on what you need to do and how to do it.

see my urgent advice needed thread you will see what my ex has been through and i just to get her income support awarded.

http://www.hmrc.gov.uk/forms/ch2-online-stubb.htm go here and download the child benefits form. make that appoinment asap with social services and your MP's office. your MP may be able to get the child benefit manager to fast track your claim by way of faxing it to him and then he will take it to the processing team, you will aslo have to send the printed copy off but they can accept the fax your mp sends off to fast track you.

in the mean time social services can help you no end you just need to call and refure yourself under SECTION 17.

have you seen the lone parent adviser at the jobcentre if not make appointment asap they will help you aswell. you will need to put these benefit sections under pressure or they will sideline you.

income support will suspend your claim due to not being in reciept of child benefit strictly speaking you do not have to be in payment but seen to be making a claim hence the need to get to you MP and fax a form through. your mp can confirm to income support that she has faxed child ben your claim form and will be able to make payment.
hi thanks for your support. citizens advice have spoke to childbenefit and been told they need to confirm with childrens father that i have sole care of them which will take upto 12 weeks and they will have to trace him to do that.
they rang social service who brought a small food pacel to last the night and said they have a duty to warn me not to call them again as the wouldnt be able to help.
im going to the mp tuesday i am just praying they can sort something out because theres noway we would last 12 week with no income atall
thanks for everyone support its helping just being able to come on here to talk to people and get advice thanks

this is absolute ludicrouse! they have a duty of care to you and your children under section 17. phone again ask to speak to the manager! as it seems your social worker didnt want the hassle.

    http://www.opsi.gov.uk/acts/acts1989/ukpga_19890041_en_4

there is the link providing their duty's under this act!!

if you get no luck with social services then get hold of you local childrens comissioner they will put a rocket up someones backside in your local services department and will make sure you get the help you need from them under section 17.
regardless of what child benefit tells you what guidline they stick to. your MP will be able to speak to a child benefit manager at HMRC, put that claim form regardless of what HMRC tell you, via your MP.

seek out you local press office also added pressure from the press can help.
    http://england.shelter.org.uk/get_advice/how_we_can_help

seek help from shelter they have a benefits adiser/lawyer who will help you no end in this situation. they helped my partner in this situation and have helped me in the past!

get back onto sacial services! look up your nearest salvation army who can provide you with food survival packs. they may be able to help with travel expenses or drop it to you in person depending on how far you live away.

make an appointment to see the lone parents adviser in the JCP, they may be able to assist you also.

let the press know your situation beleive me your not the only one that is in this situation my ex has just been through it.

If the OP's ex is still claiming tax credits and child benefit for the children they have a duty to contact him and the OP to request proof of who has the children. If they get no reply from the ex (because he hasn't bothered to provide a change of address or just ignores the form) then they will make the awards according to the information provided by the OP.

They will ask both parties questions such as where the children live, where they go to school, who the school contacts in case of emergency, which doctor they are registered with and who takes the children to the doctor etc.

This obviously takes time and unfortunately the OP and her children are stuck with no money.

In the case of tax credits once the OP's claim has actually been put on their system, even if it has not yet been confirmed as fully awarded, the OP could try asking again for a hardship payment. It's at the managers discretion though there are set criteria stipulated by TCO.

Good luck and I really hope you get some help soon.

yes thats what they said they would try to make contact with him if they didnt get a reply they could then close the claim ect, but they have to give him a strict amount of time to reply. if they can get the info required it will be quicker but if they cant contact him or he wont reply it could take upto 12 weeks. so i dont have a child benefit number to claim taxcredits, income support or housing and council tax benefit.
every thing just seems to be getting worse now if he returns he has the right to kick us out at any time, spoke to the emergency homeless section to see if they could get us in a hostel or refuge and they say we have to be actully on the streets and homeless for them to help. ive explained to them whats happened and that i dont feel safe and they gave me an emergency number just incase.
i have been searching the internet to see what benefits we can claim untill i get the childbenefit number but cant find anything at all for a situation like this.
i feel scared to ring social service again after being warn like that but if it comes to it im going to have to and i will speak to a manager as i need help i cant carry on this way.
one of my children attend school but the other is just a toddler but the health visitor could tell them its me that has then i take them to doctors if there ill or anything and same with school.
i cant think straight anymore and i am praying they sort something out we cant go on living like this and i feel like ive got totally nowhere what so ever
thanks again for all the support
  • I believe some parish churches give money to the needy, i have never used this service and think its a type of old fashioned type of begging that would keep you out of the work house type of thing. If you have nothing, then beggers carnt be choosers. I would just want my kids fed, the story i just read was not right people of a boat are intitled to a basic need, why was this person turned away, I would write to the top man and tell them what has happend, Social Services are still failing us all if they dont carry out their duty of the child act. That should be delt with, after all the tax payer, payes their wages and we want to keep the welfare state to protect all. Thats why it was created in the first place.

you can claim jobseekers allowance only at a single rate though whilst this claim for income support and child tax credit and chb are being processed

casseus is right in what he/she says, if you feel too scared to call social services the call the childrens comissioner they will help you as they have a duty to to protect your children.and will lias with social services on your behalf to get the help you need.

i also second on the calling shelter and asking for their benefits expert, he may be able to help, and the MP.

poor you i bet you feel like the world is falling from your hands, but you hang in there and fight for what you need. the best advice is here in your thread by knowlagdable posters, all you have to do is fight for whats you need. be strong. hugs from me it will be sorted sooner than you think if you get all the help you need and stay strong minded.

this is in no way helpfull and supportive to the poster how is (highlighted in red) meant to make her feel? she feels low and vunrable as the sitaution is without you calling her a beggar!

do you think the OP wanted to be in this situation? was it her choice to be in this sitaution? NO! that comment of yours is nothing short of thoughtless, shame on you.

would i be excepted with job seekers though?? i have been searching the internet all day to see if these anything i could claim but i cant find anything under my circumstances until i get the claim for child benefit. i have 2 children one is 5 years and the other isnt even 1 yet. when i first made the claim for income support last week i asked about jobseekers as i didnt know what benefit i would need to claim and she said i need to be avalible for work she said they could ask me to go for an interview right now could i do that, my answer was no as i had the children with me and she said thats what they expect when claiming jsa and i should claim income support.
i feel like i'm going round in circles with the benefit system and its all because of a childbenefit claim if it does take 12 weeks i really dont know how we will survive with no income and no rent being paid its been bad enough in this last week never mind another 11 weeks of it.
