What bills are in his sole name and what bills are in joint names? I know the tenancy is in just his name and so are the tax credits/child benefit but what about other household bills like council tax, energy and so on?0

Yes you can but again it's like CB it can take a long time to sort out, as each parent will be asked to prove where the children live etc etc.
I wonder would there be anything that Social Services could do to try and hurry things along a bit with child benefit/tax credits etc? I don't know if that's possible- just sounding off really!2011- new year, new start.

Tell the MP everything that you have no money/food/electric etc he/she needs to know how dire this situation is.*SIGH*0 -
I've only seen child tax credits awarded to a parent who wasn't in receipt of child benefit once and it took well over 20 weeks to sort out.
Child benefit will remain in the ex's name until they establish who looks after the kids, depending on how long he wants to draw it out OP could be waiting a while for this help.
Housing benefits/council tax benefits can only be paid to people who have a tenancy agreement which the OP wont have for at least 2 months unless the landlord does something dodgy/illegal so OP could well be in for a long ride.
Definitely get the MP involved as soon as possible, they have the clout to speed things up a bit but again, not much can happen until OP is the legal occupier of her home and receives child benefit for her children.0 -
hi Ella
i think that the social worker you saw or who came out to you has given you very wrong information.
under section 17 of the Children Act 1989 the local authority has the power to provide you with a section 17 payment in respect of your children
(S.17 payments are made for the child. Social Services has a duty to safeguard and protect the welfare of the child. Section 17 payments are only made to 'children in need' )
i feel your children are in need.
go back to social services, thay can help you in the intrim period until your benefits have been sorted out.credit card bill. £0.00
overdraft £0.00

hi thanks for all the replys, advice and help thats been offered, the social worker rang me again tonight to ask why they refused the crisis loan and i told her she didnt even bother to ask if we had sorted anything, she saw when she came that we had nothing and that i had sold my tv from the living room.
i think it would of been a whole different story if someone had told them i was starving my children they would of said why didnt you ask for help.
i am going to see my MP hopefully early next week its wrong there should be help for situations like this, i was practically begging for help from job centre and social service and citizens advice even rang around charitys and asked for help but they was unable to help.
hopefully everything will come together in the end but its going to take a while
thanks everyone for all the help and support0 -
Ella its over a week since you made your claim for IS-and therefore you should be able to ask them for the money you are now due-if phoning doesnt do any good ask for an (AJACS) appointment to go to the jobcentre and ask a benefits adviser there to phone the vulnerable customer team at the delivery centre; they can try to sort out an immediate payment or failing that, an interim payment. Make it absolutely clear that you have already been refused a crisis loan and your children's health and safety is a risk if they do not make a payment. (Your claim should be allowed from the date you and your ex split, as long as you claimed within 1 month so make sure they do that).
(Though realising I'd skipped a couple of pages by mistake, missed the bit about child benefit-so you may not get IS until they confirm you are the Child Ben payee, or that ex has surrendered it. if this was paid to him, you will need to show you are now the main carer and get a claim in if you havent already-but call HMRC child benefits and tell them your NI number and they can confirm if the original claim was in your name if you're not sure)0 -
hi everyone, just a update they wont pay us income support due to no child benefit number ive even taken the kids along to the job centre to prove it but they state that it doesnt prove anything. ive contacted child benefit and they said it can take upto 12 weeks to do this. ive got the tax credit form but dont have a childbenefit number does anyone know if they will take it without the number?? i tryed to ring but i couldnt get though and i kept having to ring back i tryed again about an hour ago and its still the same.
ive got to go into the MPs office to see someone hopefully they might help as i feel like i'm just getting nowhere and they just fob me off that theres nothing they can do.
thanks for all your support0
