To clarify I was not advising you can use the TT serivce for businesses. Although this is possible it is a breach fo your terms and conditions and done so at your own risk.
You can choose to ignore your terms and conditions if you wish however as this forms the fundamental agreement you have with TalkTalk I would not advise or advocate you doing so.
For your own piece of mind it may be worthwhile you clarifying independently what the legally binding terms and conditions state your rights for business use are with a legal professional.
I do however acknowledged that I am human therefore being unaware of all things at all times is something I accept, i.e in respect to the Manila call centre.
As previously advised you can choose to disregard my advice in favour of the conflicting advice you ahve reiceved from Sales and Customer Services. I only advise that TT is not suitable for business use as this si confirmed in both the termsna dnc onditiosn and the sales script you provided (note this does state agents are supposed to give you the number for Opal If you query business services and support)

I am not advising the only way to opt out of marketing is via the forum. This can be done via telephone email or letter. If you consult the code of practice link in my signature this will confirm the correct official process for this. However the forum offers an alternative tot he telephony email and letter methods and is a suitable matched contact method for those customers who choose to voice their concerns via a forum.

I decided to take you up on your suggestion and sought advice from my legal representative. I showed him the terms and conditions in my possession, a copy of the written communication I received from TalkTalk saying I could use my phone line for business and a copy of a recording with a member of TalkTalk customer service staff, confirming a note had been put on my account, saying I could use the service for business.
Additionally, I also showed him copies of all your posts, all of which which contain a link (in your signature) to TalkTalk’s Code of Practice on Handling Complaints and Resolving Disputes for Domestic and Small Business Customers
If, as you claim, TalkTalk do not allow use of the TalkTalk services for business, then, clearly, TalkTalk would have no complaints procedure for small business customers would they?

Seriously though, you may well be able to cancel under the Distance Selling Regulations.0 -
Hi Paul,
If you are happy to take the risk that in the event of a fault you would receive no business support and no compensation for any loss of business caused by a fault then by all means use the service.
The purpose of my advice was to protect your business and ensure you are fully supported as a business in the event of any issues, however you take any actions at your own risk. I personally would not operate a business using a service which does not provide business level support or any level of compensation for loss of earning in the event of a service failure. To ensure continuity of a business during the current economic times such assurances regarding operations and financial assurance would be paramount to my choice of ISP. As such I fell obliged to be open honest with you regarding the limitations of TT Residential services used for business purposes and the Terms and Conditions advised business use is not prohibited for this very reason, as a safeguard so TT have no liability to provide you with loss of earning in the event of service failure for those who do choose to use TT for business use.
As previously advised I have nothing to gain personally irrespective of your choice to use TT or not. If you sign up i do not gain commission therefore there is nothing gained from me omitting any information, be it positive or negative. The purpose of my advice is only to help people as applicable to their circumstances.
As such I thought it prudent to advise you that TT do not support businesses therefore I wouldn't advise using TT for business. We do have business services offered by our sister company Opal (http://www.opal.co.uk/), where you will receive full business support for faults. In my opinion TT is not suitable for your needs, however you do not need to take my opinion on board as part of your considerations to use TT. I do however hold hope that you do never experience any faults which result in service outages that may affect your business, as this would potentially undermine the hard work you have put into building your business' reputation by rendering you without communications for a period of time. It is this situation I would expect you would want to avoid but by all means feel free to continue using TT if this is not a concern for you.
I have fedback re the "Small Business" reference appearing in the Title of the Code Of Practice in the past to the relevant department as we do not provide business support, I can however only provide feedback to the relevant parties on this.
Mandy130 - if you singed up over the phone or online yesterday you can by all means exert your rights under the distance selling regulations to cancel the order.
TT also offer a 7 day cooling off period from the time you place your order. WE also offer a 30 day trial period from the date of connection for you to trail the service. If your unhappy during this time you may cancel without the contract breakage fee being applied.
