Hi Rob,
I did get a reference number but it was not saved in my email inbox.
Secondly they have 3 phones of mine which I have never recieved payment from, I have the paperwork from them but I do not have the IMEI numbers written down anywhere. What are the chances?

You may be able to say it was down to the directors deliberatly doing this, (it may have been it may not) but proving it would be nigh on impossible.
Earth Mobile boasted on their website that they pay within 7 days. Then in their terms it states it could take up to 14 days. Then after they have your phone they say it's going to take more than 14 days... if that's not dodgy I don't know what is. I doubt anyone has been paid within 14 days let alone 7!0 -

And they probably did till the bankrupcy started to become a possibility, just like companies like CoolNewMobile (I used them for cashbacks before) who paid out on time and perfectly until the cash flow problems started, then paymets got slower and eventually they went bust.
The point is you would have to prove that this was a deliberate policy, not an effect of cashflow issues. You'd also have to prove this was a policy by the directors, any payment issues would be against the company and as they are in administration there would be no point trying to sue the company.0 -
I agree with what you are saying Chester, however bankruptcy isnt something that happens overnight, company accountants are somewhat able to predict likely issues i.e profit warnings etc. They had issues with loads of customers over a period of time, not eg 50 customers over 2 days. They had my phones for over 2 months yet they were still accepting more phones from customers.
to dishonestly appropriate property belonging to another with the intention to permanatly deprive. Basic theft law. How is this not the same. Again I know this wont probably go anywhere but it is good to air my views, and lets wait and see if this guy or his cohorts do this again???0
