    How has your phone been stolen?

    You chose to send it to them, they went bust. It's a civil matter, and won't be covered under your insurance's cover against theft!
  • So is what he said true? Who do we contact to make a claim?

    I sent my iphone recorded delivery after it went bust and they signed for it and took it.

    I then sent a letter saying that I wanted my phone to be returned and they wouldn't accept it so it was returned! (Would have been nice if they had done the same to my phone....)
  • I've also been done for £202. I saw this morning that the message on the website had changed so I sent an email and this was the update.

    Further Update as of the 25th August 2010-08-25

    Any phones sent Freepost Earth Mobile, without any return name/address written on the back will have been forwarded to the Belfast National Returns Centre (via Nottingham where the Freepost was set up) as advised by Windsor Sorting Office today. They follow a strict procedure. They take up to 30 days to log them on their system. Customers need to be advised to wait 30 days then log a call in to Royal Mail Customer Services on 08457 740740 so that a find my item request can be raised and matched against the Belfast Returns database. The customer should tell Royal Mail that the package was addressed to Freepost Earth Mobile, the make/model of phone inside and their Earth Mobile order number written inside the package. When there is a match, the phone will be sent to the customer. In total it can take up to 3 months. Customers should NOT ring RM Customer Services now, because Belfast wont have opened the package or processed it yet, so there will not be a match and the find my item request will be sent back to Customer Services they need to give it the 30 days. On the other side, items held for more than 3 months go into storage, and after a further 3 months they go to charity. Any handsets posted by Recorded or Special Delivery that have a return address will be returned automatically by Royal Mail.
    Earthmobile are currently assessing what items are still within the business unit that have been received and unopened and where there are recorded or special delivery items these will be returned to the Post Office for return to the sender in the coming weeks. Any items received by FREEPOST without a return address will be held in storage with Trading Standards and attempts will be made to repatriate as many of these as possible once a full list has been compiled and we can cross match these with a master file being collated by consumer direct.

  • I also have been taken for approx £170, and have been watching the story unfold.

    In relation to nobbyspark's post, where does this leave the items that are opened yet no price has been agreed? I know for a fact that they were opening packages either the day or day after they were received and then disposing of the packaging, so the only return address should be on some form of job ticket (they should need to know where to send the chq supposedly?). What is the score with these? Russell - if you are reading these posts please enlighted us!

    Its a long story as to how I know this, and I wont bore you all with this now!:)

    The stupid moron was happy to accept everyones phones but cant do the decent thing and accept a letter so I might get it back!! Or maybe he is just too bloody stupid to realise he might have been doing the right thing putting my letter with the companies other mail??
    To be fair though Suzanne he has only done what is required of him now which is "not to accept any mail "
    Any mail should be sent to the registered office of the company (as per Companies House)which seems to be different to the trading office.
    My reservations about this is that it seems to be a mailbox setup due to the number of companies trading from there and it being a residential building etc etc.
    Either way sending a recorded letter to that address will prove whether it is still current and if it isn't then you might find enough evidence of malpractice to enable you and others to sue the Directors rather than the company

    OK an update for those watching this post:
    I have just called Trading Standards/Consumer Direct (08454 04 05 06) and they were very helpful.
    They are aware of the situation and are actively working with Earthmobile to get handsets returned (at least this is now confirmed by the horses mouth as such). I had to supply the date I posted the phone, Make, Model, IMEI number.
    They then said this would be passed to Trading Standards and I may be called by them for any further info if they need anything else.
    So maybe all is not lost yet! I had pretty much written off any chance of getting anything back but this does give a glimmer of hope. Obviously they could not supply any time lines, but hey some news is better than none.
    I would suggest that all others following this do the same and hopefully some will get lucky

    Just confirm this and let people know that this is correct.

    I cannot go into details as to how, but I can confirm this is being acted on by TS's and they are working on the situation to resolve it asap.

    What about the phones they have already sold? I wouldn't be surprised if they sold mine by now.

    Unfortunately I have no idea. If price was agreed and it was just you had not received payment, I would guess you then become a creditor of the company and all that entails, as per posts way back at the beginning of this thread.

    I sent my phone to them the beginning of July, so I am just hoping it is still there. I guess all you can do is put the call into TS's/Consumer Direct with your details and see where it goes. They may also be able to advise you where you stand if they have sold your phone on and what action you need to take
