He also may not be able to claim anything while he has a college place, because he won't be able to accept a permanent job.

You can claim JSA whilst only looking for temporary work, as long as it is full time (assuming the OP is not a lone parent or disabled).

yeah i think i will try it basically to cut a long story short
i got the sack from a previous employer for stealing from them
(not to be moment in life)
found this new job b4 i was charged by police and was advised by a charity company to tell them after the court hearing.
so i did that yesterday telling them im on tag and wouldnt be able to do nights

they said today either leave or be sacked but they have offered me a reference as i was agood worker.

I am a little unclear about this. You were given an curfew order with tagging as all or part of a sentence for theft.
Were you working nights for your current employer at the time? Did you tell your legal representative? the court? Was any alternative considered - eg suspended sentence? unpaid work etc?
The courts here rarely impose a sentence which means that a defendant has to lose a job (unless custody is the only option). There must have been alternative punishments - it is a shame that you had not come clean to your employer - if you were a good worker they could have supported you.

.... And as for the criticism of the defence team and the court - the OP stole from his employer[1] - so what adjustment exactly in terms of the tagging order do you think could have been made to prevent him re-offending?[2] If he had been honest with his employer then maybe they might have been willing to make representations to the court. But he will never know that because they weren't told the truth about his employment past - and weren't given an option on deciding for themselves whether they wanted to employ someone who has stolen from their empolyer very recently. Because when they asked him for his employment history on the application he said what exactly - I was sacked because I had stolen something from them and I'm waiting to be charged? [3]

    !
[1] Yes, we know he stole from his employer. I know this because he told us, not because you reminded me
[2] If someone has a day job and they are tagged, then by and large they can carry on with the day job, if their employer can cope with them. The adjustment required to the tagging order is one which would have allowed him to meet his employment commitments. I thought that the reason for tagging was to act as a degree of punishment which constrained their liberty without ripping them from the stability of normal life and leading to a cycle of reoffending.
[3] The employer should be left to decide whether to continue employment according to their assessment of the matter. The court should not preempt that by imposing punishments which will make one person's continued employment impossible while allowing another to continue in employment under notionally exactly the same punishment order.

At the end of the day, putting bigmacman out of a job all adds to the tax bill. I am paying for state sponsored stupidity.

If you post on a public board you get whatever you get. And for your information I have heard that people can change their lives and that is what the Rehabilitation of Offenders Act is for. But you have just now been convicted - a "turning around" of your life takes a bit more commitment than a few months good behaviour and a bit of volunteering, and if you don't like the fact that some people might expect just a tad more evidence that you've changed then tough luck.

And as for the criticism of the defence team and the court - the OP stole from his employer - so what adjustment exactly in terms of the tagging order do you think could have been made to prevent him re-offending? This is down to the OP, and if he wants to feel sorry for himself because he is having to face up to the consequences of his own actions, then he hasn't really got a grip on real life. And as for the last employer - one is assuming that they were more honest than the OP, because it's the easiest thing in the world to say anything you like about good references etc., and heave a huge sigh of relief after he's out the door, then go check he hasn't stolen anything from them!

this has been going on since december so its abit more then just a few months of volunteering and im the worlds greatest person. At the end of the day im here for advice not a petty fight with some1 who has the silver spoon wedged between there cheeks.
its not just a tag ive got im doing
    200 hours community service
12 month sentence suspended for 12 months.

im far from looking for pitty ive pittied myself since it all happened and it gets you nowear in life.Im looking to CHANGE my life around hence why im bettering myself in going to college.
i even explained to the courts my type of work and hours i do but they wouldnt go much further in times then they did. I think i rather be free then in prison dont you so i took what i was given. Now to be honest if you dont have any CONSTRUCTIVE words to say i say go post on some1 elses thread.

BTW if they really didnt want me there why would they said they give me a reference seems a bit strange if there going to check there stocks still there dont it really

I have a feeling that the ALG will be all you are entitled to, but I am not sure. If you post a query on the Benefits board asking about your entitlement whilst at college I know one of the regulars will be able to give you a definitive answer.

If the employer who asked you to resign would be willing to employ you on the night shift, why can't you get your lawyer to seek a review of your tag terms?

i asked a simple question all i wanted was simple anwser not you moaning and groaning.Have i once said ohhhh the place screwed me over the worlds on top of my shoulders the government wont help me. NO i did the crime im doing the time. You come in my position wear ive been and what i was addicted to and say what your saying again. If i was asking someone to bail me out i be asking for a job and some pitty.
but no im asking a question on a HELP FORUM not a pick on him hes a easy target forum.

so take a look in the mirror and GROW UP!

You were the one asking whether you could have benefits - sounds to me like you wanted bailing out. Don't give me excuses - oh dear I've been an addict so that excuses it all. This is months ago - you are a long long way off being an ex-addict, never mind an ex-thief. It has nothing to do with what you have been throuigh - or may yet go through. People make mistakes. But they don't get let off after a few months and it's all over and gone.
