first off, I do not see how an R&R could ever be a criminal offence unless there is a level of fraud involved on your part (technically, even if you know the price is wrong you are still being over charged unless you played a part in the pricing or agreed to pay the higher price out of the goodness of your heart) I may be mistaken but thats how I see it.
About banning. It is not a grey area as such but obviously there are different forms of bans. Being told that you are banned by someone does ban you but it is difficult to prove unless it is written or you have some solid form of evidence. It is hard to bring forward tresspass law charges without paper work evidence that a warning has been issued but very easy to ask you to leave a store and to refuse to serve you. It is also very easy to call the police while your in the store and say "I have told him once he is banned I want him to know that it is official and if he returns he can be charged with tresspass" in which case I suspect the police officer would be more than happy to record the fact that you have been warned in his little black book.
That really sums up banning and criminal charges, it is trespass, and trespass is impossible until you have been warned that you are trespassing. And even if you do trespass it does need some evidence in order to go to court.
Technically, you are commiting a criminal act if you are banned from that store and you re enter it, proving that you were banned becomes a whole different ball game and is best avoided by all concerned unless it is in black and white.
Trying to ban someone from an entire chain of stores is exactly the same however for obvious reasons it has to be someone with the authority to actually do it. Which is obvious really as you can not have the manager of one store ban staff from a different store from entering any Tesco land for no solid reason and therefore not able to go to work (ie constructive dismissal).0 -

No.....even though Tescos have given me over £1200 worth of goods recently, I dont work for them, but seem to provide a worthwhile service
2)that you know the polices that well
Ive read every post from Part 1 Post 1 of this forum and have read the policy boards up in the shops...and even had a meat manager bring his policy book to me the other day....although he didnt understand it either

Correct... Tesco Stores are private property, and the managers dont need an excuse to ban anyone.....

If a crime or serious offence has happenned where HO deem that, then Correct again.......but as I havent committed a crime, raised my voice or insulted anyone, then it is that store managers perrogative to bar me from his store....If he then wishes to phone his store manager mates and tell them about me, well thats his perrogative as well, but if he sends my photo to his mates...then thats against the DPA(Data Protection Act), and as I (now) dont use my Credit or Clubcard(for possible argumentitive RnRs)......how does anyone know who I am.....0 -

As I posted earlier...This is what I was accused of....The two managers to ban me, both said that "as I knew I would get a refund, they deemed I was acting fraudulently .................but (again as posted earlier)
Remember the Prunnella Scales advert of the 90's, with the little old granny scanning her stuff, realising the price was ok, and putting it back on the shelf and saying something like "oh no, that ones no good"......
Now please tell me...if Tescos can advocate such a policy in a worldwide TV advert....how the H*ll can I be acting fraudulently0 -

I remember this well and thought it was quite good at the time; the implication being that they were so confident that their pricing was correct that it wasn't worth the trouble! :rolleyes:
If I was ever pulled up for scanning before purchase I would use this advert in my defense.0 -
