    Hi,
    I am encountering my first unusual r&r situation today !

    Was in Tesco last night and saw leaflets all over the store (on the tills) stating that I would get 10% off ALL Tesco Mobile Motorola phones, on closer inspection I saw that the SLVR L7 phone was only £89.97 under the promotion !!

    So I went off to the phones department to get the phone, and saw it and picked the empty DVD case straight off the shelf. After having gone through the checkout I noticed, whilst waiting to collect my mobile phone, that the phone had gone through at £99.97 NOT £89.97 !!!!

    So I asked about it, and I was told by the manager who was called by the assistant at the desk, that I was not entitled to anything at all as it didn't count as an overcharge, as Tesco were not breaking the law because there was a promotion end date in TINY TINY print at the bottom of the leaflets, and it had expired over 2 weeks ago !!!!

    He said they hadn't broken the law by leaving them out, because they had put an expiry date on the leaflets. He said it would only be a misprice if there was no expiry date and the price was on the shelf itself.

    So I rang Customer services today, and the lady told me confidently that it wasn't an overcharge because the price wasn't on a shelf or poster above/next to the item itself, as it was only a leaflet it didn't count; and therefore Tesco wouldn't honour the offer price!!

    SO .... somewhat dumbfounded, she offered for me to speak with her supervisor, so I accepted knowing no better what to do next .... and supervisor was busy on another call and is now supposed to ring me back before 2:30pm today.

    Long post I know (sorry) but I really am at a loss what to do next when the supervisor calls. Can anybody help please with my rights and comments on the way Tesco have handled this so far, fairly/unfairly??

    Well done for perseverence, see also my previous post if you do get into any discussion on this item. If it's an 'Autumn' leaflet and the website is also at the lower price I can't see how the instore price was ever offered at the lower price.

    Yes well done, don't forget to use your print screen button on your PC to save and print the screen out. Obviously the "in-store" wording sort of mucks it up a bit but you say that you had checked the prices prior to leaving and after returning home. Put it this way, it would be reasonable to assume that the actual price was £129 as you would expect the website to be the most current price as a shelf lable has to be manually updated in each store.

    What a crock! If an offer expires, the promotional garb should be removed, like I have said before, if you had poor eyesight, all you would see is the offer, that's how TS will see it! The majority of R n R's are given due to expired SEL's. Me thinks this manager is peddling as fast as he can, they must have ALL been warned about leaving these things laying around!!

    Tell them you will be contacting trading standards as they have advertised an offer, with tiny offer end's date, but left the bumph everywhere! Enticing you to buy!

    ... but what if, as in my case, the SEL says £99.97 which was charged, but the only thing to say it should be £89.97 are the hundred of leaflets around the store and at the checkouts ! The customer services is claiming that overpricing only counts on SEL and POS posters.

    ... I would say, like you, that the leaflets all over the place are very misleading, especially considering HOW SMALL the expiry date is on it ! And the fact that the leaflets are all in little containers which cover the bottom 1/4 of the leaflet and therefore the ENTIRE terms anc conditions small print is not in view regardless of strength of sight!

    ...Does anybody know where I/Tesco stand in relation to the trading laws?

  • put it this way, you are driving past Mr T's, Big poster outside says "£50 off your £100 shop" you go in, fill your trolley, lady/man @ till says "£100 please" "but what about the offer?" says you, "Oh that ran out 2 weeks ago"

    Trading standard would back you up.
    Tesco have left enticing material lying around, same thing as above scenario, I'd phone CS' back up and ask to speak to a supervisor.

    Take no Prisoners, or POO!! LOL

    You have the right to write a letter to HO and keep a copy for yourself sent by special delivery informing them that they have 7 days to solve this problem or you feel the only real solution is to report it to TS and ASA and let them deal with it. You can tell them that you would rather not have to do this as the way you see it if the full refund offer is given then a proper solution has taken place. A partial refund is not acceptable as you feel your rights have been violated.

    Inform them what happened and where you expect to take it now should they not comply with your request.
