    Adrain Russell has just rung and said they have spoken to there legal department and this is not a overcharge and i will not get a full refund and get to keep the items!!!

    Trading Standards and Advertising Standards Agency for complaints, you could try contacting head office again and ask for Joanne Leith or Kevin something or other as posted previously in the thread lot's of people have had a better response from these two although Joanne may be more difficult to get hold of due to her senior position if you ask for her by name that just may do the trick.

    If this Adrian Russell has indeed spoken to their legal department he was clearly speaking to a complete d*ckhead.

    Western Avenue are recoiling from all the r&r's they have been handing out due to their incredibly poor housekeeping standards. In my experience this is one of their worst stores to deal with, they are very skilled at provoking a situation, some of the till runners are accomplished wasp chewers.

  • What else can we do?

    Send HO a letter via special delivery, Give them (HO) a set date to reply and inform them that if you have not recieved an official reply by that time then you will be taking it to trading standards.

    Tell them that under law it is an offence to give missleading price indications which although correct at the time becomes misleading after it has been given: If the custumer could reasonably be expected to still be relying on it and reasonable steps were not taking to prevent it.

    Tell them that you also feel that leaving signs and posters up was also a failure to prevent you from feeling that the offer was still valid.

    Tell them that you feel that the policy of giving customers a refund is part of their overcharge prevention program as it helps prevent Tesco from making a profit from overcharges.

    Tell them that you feel that because they failed to prevent the occourance of overcharging in two incidents, the first being leaving the posters up, the second being that they failed to stick to there own overcharge prevention policy, that you feel you have a strong case if they wish to ignore your offers to settle this matter with a full refund.

    PS I did make a promise not so long ago that I would no longer talk about legal matters, my bad. I find it impossible to do this as the legal matters are sometimes a part of the whole disscusion. What I will say is that if anyone disagrees with me then that is fine and I will take no offence as I am just trying to help other out by giving them a nudge in the right direction. Of course you should always seek legal advise when dealing with legal matters. I am just tellig you what I would do.

    If we ask for Joanne Leith or Kevin ? by name are we then not leaving ourselves open to them saying we knew about the overcharge because we go on this site?
    I must admit I'm reluctant to ruin it for everyone else if I point out this site and therefore others who have got their refund.
    What have others said when you ask for a person by name?
    I must admit I'm surprised I still haven't got a reply to my emails, what takes them so long.
    I've asked before but haven't had any joy. has anyone got an email back saying sorry you are not getting an R&R? or do they just ignore the letter?

    It appears that anyone refused an R&R on an Xbox was successful in the end. You just need to stick to your guns and write a letter if need be.

    When I have to ring CS about an R&R I explain the situation in brief to the person and ask whether I should've got an R&R, if they say no and agree with the manager then I just say thanks, hang up then ring back and speak to someone else. I did this about 5 times the other week until I finally got someone who agreed with me. I then explained the situation in full and they called the store to authorise an R&R :T

    Views from the CS staff at Dundee seem to vary so much, some of them don't even know the policy themselves :rolleyes: For this reason I don't think I'd ever ring CS from the store, as I wouldn't want to get through to some numpty - I'd rather go and sit in the car and call a few times until I got someone who agreed with me.

    Anyway, sorry for the ramble! :o Good luck in getting your R&R!:D

    Just writing an email to complain but what to copy everyone in.. so if anyone has any good ones then please let me know.

    Thanks for that. I did call once I had left the store explained briefly and apparently ;) there is someone called Joanne dealing with this and she would call me back after 10 today. No call as yet but I am keeping everything crossed.
    I am slightly worried re the wording of the poster implying the £20 is off the game but its not clear and as I said worst case I will refund the lot.
    Its for DS birthday in October and I have already got console from Boots with 10% etc previously posted.

    I think its through contact us on Tesco.com but they are not very speedy so probably best to write a letter
