I like to think I adopt the "Put up or shut up" approach.

I think that's exactly what to call the approach you take :D

R&R is a funny old thing, just as i was acting as if i didnt know what R&R was whilst getting my 6 bottles of free WKD tonight, the bloke dealing with it was telling me a load of inside information about how Tesco CS try to get out of it when they can, as they dont inform the customer about it, and try to fob them off with partial refunds etc. When you take a step back, its completely unfair and wrong for CS staff to do this (or be trained to do this) seeing as the policy is Tesco's own one! So I took my £48 worth of free stuff home tonight not guilty in the slightest.

By the way, if they say no on the grounds that you accepted the game at R&R make sure you inform them that you did this as you felt under duress to either accept the offer given or get nothing.

I think it is fair to say that managers are putting customers under financial duress (accept this offer right now or get nothing) and so you feel that the agreement you made with the store manager is vitiated by the fact that you felt under duress and it has been less than 14 days since the agreement.

Understand that a contract is null and void if you feel it was made under duress and it is within 14 days of the event, understand also that you do not need to prove duress as it is enough that you felt under duress. You might want to explain that to Tesco HO as they might or might not be aware of it.

A bit of legal jargon for you all to get your heads round ;)
They say that possession is nine tenths of the law, when it comes to consumer law the word possession should be replaced with "perception" If you are mislead in anyway the law will protect you.

lol brilliant, I like it and will certainly try that.

I think the CS actually wanted to give it me, just that she couldnt as thats what the store manager has said about these consoles etc. The CS were cracking, not horrible wicked witches like some of them! they were doing their best to keep me at ease.

I kind of like the approach, "Excuse me but I am making a stew and this appears to be lamb dressed as mutton" do you have any mutton? :D :rotfl:

Exactly! I was a bit nervous about the whole thing as I broke my R&R cherry today. I'm planning on going to another store tomorrow to stock up on WKD and bbq ribs though - party at my house lol! :rotfl:
  • Just for a bit of backup on this duress law I have taken the trouble to look up duress in contract law on wiki (not exactly the best source but good enough to just say there is some foundation to what I am saying)
Although hard bargaining occurs legitimately in commercial situations, there is a point where it becomes economic duress. Putting aside issues of consideration, this often involves one party threatening to breach an existing contract between the two parties unless the innocent party agrees to enter into another contract. The contract is voidable if the innocent party can prove that it had no other practical choice (as opposed to legal choice) but to agree to the contract.
    Retrieved from http://en.wikipedia.org/wiki/Duress_%28contract_law%29

You see? The manager threatened to breach an existing contract unless you entered into another one. Although I am pretty sure in english law that prrof is not required, a 14 day limit is thought to be enough proof.

Saw a poster for £10 off PSP and GOTW bundle which was Tekken. Noticed the poster says "Save £10 when bought with a PSP" or words to the effect that the £10 was off the game.

This is strange I hav seen the white and the black value pack trigger the discount with tekken, I havnt tried the others

Which PSP pack did you buy?
    black base £149
    White value £ 180
    Black Value £180
    Giga pack £209
Giga pack with 2 games the expensive one I think £225

I would be happy to walk away with tekken as I want the game I already have a PSP for myself which I bought and I got another last week r+r for my sisters birthday present with an out of date poster showing gangs of london which I had already bought.

OK can I have your thoughts please guys.

Discount didn't trigger at the till and I took it to CS who went to the manager who told me that the £10 was off the game, I can have the game R&Rd. I pushed a bit and the manager stood firm.

Are tesco right? The poster honestly says words to the effect of "Game of the week £10 off when bought with a PSP" which says to me that the saving is off the game, not the bundle. Where do I stand? Was I just too soft???

See my post on the misprice thread Dude!
