    Yes, I have no need to make any future claims as per my contract with Mobiles.co.uk BUT of course we are still contracted as per 02 with the tarrif etc.

    I did not want to have to go through all this again naturally for something that was made out to be so simple. In fact our first claim was excellent and paid straight away but this other one was a night mare. All done and dusted though now.

    well having read that saga, it feels a little dull to say that i received the cheque for my first claim this morning. the email-before-action obviously did the trick.

    based on what it says on the cheque, that makes 7 days from EBA to the cheque being raised, and a total of 9 days to having the cheque in my hand.

    i wish i'd sued for the full amount now!

    It's the same with every thread if you look it's no reply to any emails untill it's too late etc ...It's not just you they ignore it's all the customers ...read the threads theres loads of them complaining about being ignored ;)
    This company never stops making mistakes as you call them they have been happening well over the 12 months I've been keeping tabs and I'm sure it will carry on.

    Eventualy put it right after taking them to court and thats acceptable and fair actions from a company is it ?

    Yet again we are left with a situation of "I'm alright Jack" when someone manages to get the problem sorted out through the legal process and yet theres countless other poor customers who are unaware of what they can do because they don't visit this forum or have the availability of advise such as that given on here !!!

    Too right it shouldn't have happened and the problem is that you are by no means the first and no doubt you won't be the last which is why you shouldn't be impressed by the company nor should you make such an statement as "They have proved "to me" they are a fair company" becuse nothing could be much further away from being "fair"

    That's the major problem and probably why it's just a numbers game for Mobiles.co.uk. How many issues don't get followed up and the vulnerable lose out??
    It is thanks to sites like MSE that issues are highlighted and members can be helped to sort out their issues.
    How long before it all happens again?? It's strange that I've had really good service from E2save (same group), so the assumption must be for me that it's an internal thing at Mobiles.co.uk. It just seems a game for Mobiles.co.uk - are they hell-bent on being top of the league for rejections, poor customer service and continously breaching their T&C's??

    The thing is now, everytime they breach the T&C's it would make sense to just LBA them immediately (7 days should be suffice), and if not sorted then MCOL for the full outstanding amount (plus costs).

    I'm really looking forward to my claim in October, it will be sent signed for (I seriously doubt that the emailing system they set up was to help customers) and they won't get an inch. Hopefully they will sort it as it should and they way they promote - but they also know, there are other ways to get what is due.

    It was good to see that Mobiles.co.uk did sort marshallka's issue very quickly once they were made aware of the MCOL - it did stop any further anxiety for her and obviously now no more concerns for the future. BUT IT SHOULD NEVER HAD REACHED THAT STAGE.

    Pleased you got sorted, but puzzled at your (revised) view of them.

    They responded promptly only after getting a summons from court for the money they owed you!!

    It's far from impressive that a so called blue chip company is prepared to send their customers along this route. Many wouldn't go to the lengths of paying for and issuing a summons.

    And when they got the summons, even then they acted very badly (by agreeing to pay it only on condition you proved to them you had cancelled the case). (In future wait till you get the payment and it has cleared through the bank before cancelling a court case.)

    In fact that gave them the opportunity for more delays (and we saw that happen in the e2save problems thread at the time they were the cpw public enemy no 1).

    If a defendant pays up the amount claimed on a summons in full within 14 days of receiving it, then there is no case to continue anyway - the summons has done its job, so why would they insist on making the claimant cancel the case before paying up what they clearly agree they owe in law?

    True Lynsey, it should never have reached that stage and it was stressful for something that was made out to be so simple.

    Silk, please do not think I am saying "I'm alright Jack" because I have clearly written what I did to get all my cashbacks in one go (as per them faulting on the contract in the first place) and I have tried to help others here too. What do you want me to do Silk? I was only stating that "for me" they had sorted my problem but I did state that I was maybe a lucky one and I know others are struggling too as per these threads of unhappy customers.

    They did not sort the problem out !!! You sorted the problem out and took them to court and Won
    And well done fo doing so .....but don't think it was down to luck or the company being fair.

    Either way I'm pleased you sorted it out

    Thanks silk, I am certainly not a sort of person that thinks "I'm alright Jack". I help out on this site as much as I can if you look back at my posts. I just did not know so much about mobile contracts and sorry if my wording offended anyone, maybe they were not a fair company and it was not luck then and sorry again if I maybe used the wrong words here. Certainly not wishing to promote them but was just saying that I did get it sorted however.

    Is that 2 separate contracts or only 1 contract that has 2 missing claims?? If it's the latter, then why have you let it go so far??
    What was their reason, if any for not paying??

    Luckily, as long as you have complied with the T&C's correctly, you can make them pay up. I would send a LBA giving them 7 - 10 days (7 is enough) to pay or inform them you will sue for the full amount of cashback that your contract was for in one hit due to the breach of contract.

    If you read back the last few pages here you will see that it can be sorted, but needs a little pressure on them unfortunately.
