Drunk driving in a Motability car.

    Hi all,
    Just to update you all, the women who was drunk driving in this thread was banned Today ( Monday ) for 1 year and fined, but I found out that on the Friday before she was banned she ordered another Mobility car, this is less than 14 days since she wrote her car off due to her drink driving..... UNBELIEVABLE!!!!!!

    Ooops -I'm guessing she'll get written off the scheme - sorry, but they are very strict on that sort of thing! She might not be able to get back on it again.

  • Someone who is unable to drive can nominate another driver. In other words, she may be able to order another car and still use it provided she doesn't drive it.

    As for the "Insurance company won't pay out because she was drunk", they first of all have to prove that her intoxication was a contributing factor to the accident. It's not that she has to prove she lost control due to something else; it's that they have to prove she lost control due to the drink.

    Motability is a VERY large scheme for RSA. They are likely to turn to Motability and say "We'll pay the claim and claim back off the customer" to keep Motability happy and make it sound good. Then someone who actually knows about insurance, rather than a load of people speculating about it, will review the file and decide whether they have a chance of recovery or not.

    I'm afraid I have no further update and as far as I know her new car is on order still, but I have been further advised that her new car can be canceled right up to the minute that she goes to pick it up.

    I am also in the process of ordering a new motabilty car (my 3rd) and it has all gone through and the car is now on order. I would doubt if Motability would allow the car to be built to order unless all the relevent checks have been passed.

    Many thanks for your very informed comment, but surely RSA would say that the fact she was driving the car whilst drunk is the cause of the accident because if she had done what any level headed person would do and leave the car where it was, then technically the car would still be in one piece and not wrote off?
    I was always led to believe that most if not all insurance companies would refuse to pay out for damage sustained to the car once the driver/registered keeper was convicted of drunk driving.
    I realize that RSA would probably pay out any third parties if involved.
    I did point out to my Friend that RSA could possibly pay out Motability as Motability gives RSA all its insurance work.

    Hi all,
    I am looking for some advise for a good friend of mine who's girlfriend has a motability car.
    Last week they had an arguement and she stormed off in the car whilst drunk and she smashed the car and I believe it is to be wrote off.
    She has been charged with drunk driving and is awaiting a court appearance, she was twice over the legal limit.
    What I want to know is will she be allowed another car or will motability bar her from the scheme.
    I realise she will probably be banned from driving but could she still get another car as long as someone else is insured to drive it?
    I do not condone anyone drink/driving and I believe she has been very stupid and deserves her punishment.

    anyone who has a mobility car and is caught drink driving automaticly loses their car no if or buts the car is taken from them and wont be allowed a other car.thats the rules.

    Thats the thing where are these rules in black and white?
    Although i agree with what people are saying on here, she has a nerve to try and get away with this.
