Drunk driving in a Motability car.

Hi all,
I am looking for some advise for a good friend of mine who's girlfriend has a motability car.
Last week they had an arguement and she stormed off in the car whilst drunk and she smashed the car and I believe it is to be wrote off.
She has been charged with drunk driving and is awaiting a court appearance, she was twice over the legal limit.
What I want to know is will she be allowed another car or will motability bar her from the scheme.
I realise she will probably be banned from driving but could she still get another car as long as someone else is insured to drive it?
I do not condone anyone drink/driving and I believe she has been very stupid and deserves her punishment.

She'll have no insurance either, so will still have to pay for the car she smashed up.0

A. Customers can nominate two drivers. If the disabled person intends to drive, they count as one of the permitted drivers. Nominated drivers can be changed during the lease and a third driver can also be added by paying a little extra. Young drivers can be one of the nominated drivers but there are restrictions on the vehicles that drivers under 25 can be insured on and a higher insurance excess will also apply.*SIGH*0 -
I do not think she will be allowed another car,,as she is the 1 on the scheme,,as far as the insurance paying out for the repairs needed ,,I think that may be dodgy as well0

I still would like to know if when banned she would still be entitled to another car through the Motability scheme as long as she doesn't drive it and another person is designated as driver?

As the Insurance will not pay out, she will not be able to afford another car as she will still have to pay mobility until the old one is paid off.
Being drunk voids the insurance on a personal claim.
After she has paid off the car, wether or not mobility would have her again as a customer can only be answered by them.0 -
Hi, I used to work for Motability a long time ago, as far as I can remember the situation is that no new application will be accepted until the insurance with the written off car is sorted and as already said if the driver was drunk this will probably have to be paid for by the customer not the insurance company.
One way of paying for this is that motability can hold on to the DLA until paid off or up to the original end date of the agreement. Any left over debt the customer would have to clear themselves.
Once this has all been resolved and paid off if the customer is still in receipt of the correct benefits she would be allowed a new vehicle but not allowed to drive it herself even if she does retain her licence which is unlikely.
The best thing to do is ring Motabilty customer services be totally upfront about what happened and ask for their advice.0 -
Hi all,
Thanks for the replies, I found out yesterday that the car is definetely a write off with over £11,000 worth of damage.
My friends girlfriend still thinks she will be able to get another car even though she realises she will probably be banned and believe it or not has actually started touring the motor garages looking at new cars.
( 10 days after writing her last mobility car off while driving drunk )
She says she is still entitled to a motability car and will have to nominate another driver to drive it.
Me personally I think she is in for a shock once the insurer Royal sun Alliance find out about the drink driving causing the accident.
