Drunk driving in a Motability car.

    Hi all,
    Thanks for the replies, I found out yesterday that the car is definetely a write off with over £11,000 worth of damage.
    My friends girlfriend still thinks she will be able to get another car even though she realises she will probably be banned and believe it or not has actually started touring the motor garages looking at new cars.
    ( 10 days after writing her last mobility car off while driving drunk )
    She says she is still entitled to a motability car and will have to nominate another driver to drive it.
    Me personally I think she is in for a shock once the insurer Royal sun Alliance find out about the drink driving causing the accident.

    She will definitely be in for a shock if she has been found guilty of drink driving.
    If guilty, Royal Sun will not pay out her claim (they may pay third party involvement through agreement with the other insurer). If she smashed her car into a wall, though, she has lucked out.
    Motorbility will not let her take out another car as she will already be paying for one and will have to continue paying for it untill the end of her agreement. (Till the car is paid for)
  • Sorry for butting in but what happens at the end of the term as she'll have no car to hand back? Bright side - she will probably be within the allowed mileage... :D

    Hi again,
    Just to let you all know she intends to order a new Mobility car on Monday and intends to spend the weekend touring the garages to make her final choice.
    She writes a Mobility car off 11 days ago whilst drunk causing £11,000 worth of damage to the car, has been charged with drunk driving and incredibly she seems able to just swan into a dealership as if nothing has happened, NO WONDER THIS COUNTRY IS IN THE MESS IT'S IN !!!

    p.s. who pays for the damage to the wrote off car, will Royal Sun Alliance pay for it or will they refuse due to the drunk driving????

    Given what you've said, can she even get a new car and drive it? I don't think so, somehow.

    Technically the computer will throw out the application as it will show she still has a motablity vehicle. When she has to speak to them to explain situation she will find that No sh cannot just have another car!!!

    Simples!!

    On most insurance policies for cars - motability or not - it asks whether you have ever been charged or convicted of a driving offence.She has been charged and will have to declare it to the motability insurance company, I think they will refuse to insure her or make it a massive excess on the policy.

    Okay I understand that she will be unlikely to get insured through Mobility to drive another Mobility car due to her impending drunk drive charge, but what I really want to know is can she in such a short space of time write a mobility car off through drunk driving ( and she is the car holder) and 11 days later order another car as if nothings happened?
    I would imagine that Royal Sun Alliance wouldn't in the case of a drunk driver who writes her mobility car off pay out for said car so I would imagine that Mobility would be looking for the cost of the car off her before allowing her to get a new car.... SURELY!!!!!!!

    As stated already above in some posts, this is what will happen..

    1. she will go to order the car

    2. the dealer will take her order

    3. motability will check the order and will approve/reject it. They will see she has already has a car on the scheme and will query why she is reordering. Once they find out it is written off due to drink driving then they will reject the order.

    If somehow motability does approve the order she has to fill in the insurance form and declare any offences etc. and it will be rejected through that route.

    This is how i have been told the system works.
    Problem with having access to internet is that i get asked by many to solve their problems :( Well at least i learn something on the way :D

    Just to update you all, the women who was drunk driving in this thread was banned Today ( Monday ) for 1 year and fined, but I found out that on the Friday before she was banned she ordered another Mobility car, this is less than 14 days since she wrote her car off due to her drink driving..... UNBELIEVABLE!!!!!!
