Just to say - the other posters are right about finding out about the legal position and pressing for your rights. Just because he doesn't have a written contract of employment doesn't mean that he doesn't have any. It is amazing what both large and small employers try to get away with.
A close relative of mine was 'retired' from their job recently - notified by a message on a noticeboard. Employers weren't going to pay anything - but it has worked out an extremely expensive lesson for them by us forcing through legal entitlement. Started off threatening to take to court for breach of contract - didn't have to do it in the end - well crafted letters (showing that we knew what the law stated) and bingo - cheque received in the post for the full amount.0 -
morning all thankyou all for your very positive posts things are looking up since yesterday my dh will start work on tue on a site which will provide him with 6 months work at £100 extra pay per week..i dont think he will be under contract but it will give breathing space while he looks elsewhere for something a bit more permanent......i am currently filling in an application form for a job with the local council which would be a permanent position same pay but less hours, i would really like him to get this as i think it would be a bit more secure?? this would start in approx a months time-my worry is he is on a waiting list for an op on his arm and i think this will put them off employing him..he spoke to someone yesterday who said he was ideal for the post so i dont know we will see...we do not have loss of employment ins as we felt to be honest we were both safe with our jobs (duh i know) but if youve worked for someone for that length of time you would expect at least a bit more notice im soooo shocked at how he has been treated....anyway he is not completing any forms for self employment phew! thankyou very much again you were well within your rights to say told you so you silly mooo but at least its given us kick up the bum to get ourselves sorted in case the worst happensStepchange dmp £6350

another update!! dh just rang had meeting with boss-boss said basicallay sod off bring van,tools etc back mon morning no wages no nothing -dh protesting that he is due payent boss says he hasnt got it -god im sooooo:mad: - anyway meeting abruptdly ended with boss saying they will talk later when his wife is present !!!!!!! ive told him when they talk later to not hold back and tell him he knows his rights and will see him in court-cant believe it he even told him he might need him in a few weeks what a cheekStepchange dmp £6350

advice please my head is going to explode!!!!the boss has just rung him to say he has work for him next week-my instinct is to refuse and stick to the work he is due to start tue but then he wont be entitled to redundancy will he? but if the same happens next week the job offer may no longer be there!!!! what to do??Stepchange dmp £6350

I think you need to be careful second chance with OH going back to work there, my neighbour had exactly the same thing, they told him where to go. It would be different if OH hadn't already had an offer perhaps.
No expert, but I can't see how the offer of casual work will affect redundancy, do you think he thinks he being clever, by offering OH occassional work he hasn't laid him off? Could you ring acas today and get some advice?0 -

second chance.. if the DH boss is saying he can not make a wages payment because he has not got it.. and to bring the van back.. etc.. etc.. (basicicly miffed that he has another job by the sound of it)
I read that to be that the company is trading while insolvent.. (can't meet its liabilities bills etc)..
if they are a limited company ... then the directors are in potential big poo pile..The only place where success comes before work is the dictionary…
