    he wasnt self employed but his boss is urging him to do this as from tomorrow by completing the relevant paperwork im guessing he wants him to do this as it would invalidate any redundancy claim?:confused:

    Yes, that sounds exactly what he's trying to do. I don't believe he could make it work retrospectively, but would urge your OH to take legal advice before signing any paperwork. The boss is a slippery customer, by the sound of it.

    Check it out with CAB first because as you said, it may affect his redundancy.

    Please, please don't let him sign the paperwork his employer is asking him to! Why should he, the employer is laying him off anyway, so he can hardly get the sack for refusing can he?

    Stay calm and get an appointment at the Citizen's Advice bureau, even if it has to be next week, as he can retrospectively get his redundancy and it seems certain he must be due something!

    Ask your OH to read these posts here, make sure he knows not to sign any self-employed forms!

    If he has worked for the same employer for 16 years there is a contract whether written or not! I hope the employer has been paying his tax and NI contributions. The CAB will help claim what he is entitled to, and if the employer can't pay there is a government fund which will cover statutory redundandancy. As soon as he is out of work he should sign on as the JSA will not kick in until his next pay packet wld have been due and if he delays I think he could lose however many days pay (JSA) it was.

    Where's Mc Birnie (sp). He's the union guy who would have more up to date info than me.

    I think his employer is trying to get him to go down the self employed route so he can use him "as and when" the work comes in thus avoiding redundancy. What are these forms his employer is asking him to sign, what is the form no.? Has his employer given him anything in writing? I would get him to phone ACAS this afternoon and someone will speak to him regarding his situation.

    Not sure about out and out grants, leave it with me and I can check it out. But in prep for that, if your hubby has himself a good memory of clients etc, then he is halfway there together with a good business plan and forecast he could walk into a bank no probs, even better if some of those clients had some firm orders so it becomes an advance to set up as opposed to a loan and if its a route you go down go the DTi route which takes 75% of the risk, so your risk is only 25% of the relative amount to setup.

    Sounds confusing but it is quite easy and happy to help if need be, but first and foremost would need to be something that your hubby and yourself want to do as it is easy for me to say go for it. Will try and get some further details for grants etc.
