    I have a slightly different question about MH and apologies if it's the wrong thread.

    At regular intervals I get letters from them addressed to other people. None of these people (it's about 3 different ones) are known to me and weren't the previous owner either. I've been there for over 6 years.

    Each time I contact them to advice that the person is not known and ask for them to adjust their information so I don't keep getting letters. However they claim they can only do it for each case once informed, and not for a person. Now coming from the IT background that I do, I struggle to believe that they don't have some sort of relational database where they could just flag the person up as no associated with my address.

    Is there anything that I can do in terms of further action. I'm fed up of having to call their 0844 number each time. Can I complain about harassment. Should I e-mail them instead (or is that going to lead to a stream of e-mails etc, though I can set up a new e-mail just to deal with this sort of thing).

    It is minor compared to what others have to go through, but am happy for anything anyone can suggest.

    It's his property if it's on his mat. And considering no-one can trace the owner of the mail he'll be allowed to open it for tracing purposes.

    Anyway, that's not what Section 84 of the Postal Services Act 2000 says:
    Interfering with the mail: general.

    (1)A person commits an offence if, without reasonable excuse, he—

    (a)intentionally delays or opens a postal packet in the course of its transmission by post, or

    (b)intentionally opens a mail-bag.

    (2)Subsections (2) to (5) of section 83 apply to subsection (1) above as they apply to subsection (1) of that section.

    (3)A person commits an offence if, intending to act to a person’s detriment and without reasonable excuse, he opens a postal packet which he knows or reasonably suspects has been incorrectly delivered to him.

    (4)Subsections (2) and (3) of section 83 (so far as they relate to the opening of postal packets) apply to subsection (3) above as they apply to subsection (1) of that section.

    (5)A person who commits an offence under subsection (1) or (3) shall be liable on summary conviction to a fine not exceeding level 5 on the standard scale or to imprisonment for a term not exceeding six months or to both.

    And? Who's gonna come round and arrest the guy for opening mail? No-one, that's who. Have you ever opened a letter with a different name but the your address by accident? I have.

    The DCA shouldn't be chasing an individual they have been told doesn't live at the address anyway. What's worse? Opening some mail to ensure a bailiff doesn't come knocking, or the DCA for breaking the DPA and various guidelines set out by the OFT and FOS.
  • OK, for the record I open them because I recognise the name as someone who has used my address for fraud purposes.

    I am aware of what the letter of the law says, but I think that 'attempting to prevent further fraud' might be a reasonable excuse to open it.

    Sadly when I have tried to warn companies in advance, they seem very unbothered about the prospective fraud!

  • today i recived a letter from MH called a doorstep assessment it goes on to say that they are going to my local court and issue a claim against me and so that i will owe more and also to get money they will apply to my place of work. the thing is i was made bankrupt 3 yrs ago and this bill was on my lists i do have a upto date credit rating from Expearing all the other debet have been showen as satisfactory.

    i dont know what i need to do weather to call them or not can some one advise please
