McKenzie Hall are well know for buying up old debts and attempting to enforce them.0

My partner received an letter from this company yesterday to his old address. He did try to ring them but having googled it and finding this post he has written a letter. My partner did have a bank account with the company they claim to be working on behalf of, but this was when he was a student aged 18-19 years. He is now 30!
As far as he is aware the were no outstanding debt on the account and he states he has had no correspondance from the bank themselves since then.
He's used the template provided on
http://www.debtwatchdog.com/statute-barred-debt-england-and-wales-Article-215.html
and will be sending this tomorrow. Is that enough, for now?Fantastic Expectations Amazing Revelations0 -

It should be, providing (i think) there is no ccj against him for the debt...0 -
As far has he/we are aware he hasn't.
It's come an an bad time. We're seeing a mortgage advisor on Monday
.
He's being forced into doing a credit check when he gets home from work though!Fantastic Expectations Amazing Revelations0 -
When i spoke to Mackenzie Hall they said i owe Kay's catalogue £2200 from 2007.
I said why isn't there a default on my credit file? she said not every company puts a default on your credit file.
When a debt collection agency buys a debt they put a default on your credit file.
So not having a default on my credit file means its statue barred and it dropped of my file.
The catalogue wasn't 2007 it was from 1995 so Mackenzie Hall are lying.
They have no records apart from debt amount and company owed.
I asked them to show proof or don't annoy me again but i doubt they will.
Lowells were trying to get me to pay old debts that were statue barred but there weren't going to tell me they were statue barred?
They just wanted me to pay up until i said aren't these debts statue barred? and he said yes and were wrote off.I'm not poor i'm just skint0 -
It's true, not all companies process default notices. It's rare, but it can happen.0

We sent off a letter to Mackenzie hall querying their claim that they had sent saying my partner owed £400 and something pounds to Yorkshire Bank, using one of the templates suggested on here re being statute barred.
They have replied and said -
I write with regard to your recent letter.
Upon investigating this matter, based on your comments and the data held on file regarding the above ref account; I conclude that said account has not been deemed to be statute barred.
Please contact our call centre on 01563 554 540 quoting above ref number to discuss the matter further and replayment of account.
Thanks your patience.
They have not provided any details of outstanding debt or supplied any evidence, and this doesn't show on my partners recent credit check as an outstanding debt.
My partner had this account when he was 19-20 ish. He is now 29 and had heard nothing at all since then from the bank itself. As far as he is aware he didn't have anything outstanding on the account.
What should we do now?
We're not going to ring them. So ... we're looking for the next template letter to send them. He will pay the debt off, IF they can prove he owes it, but as they haven't where do we stand? And, why doesn't it show on his credit check?Fantastic Expectations Amazing Revelations0 -

Looks like you've got good advice on another thread!

My partner has recieved a letter from Mackenzie Hall today demanding that he pays over £3000 by noon 25th July - the date on the letter is 18th July.
As far as we know the company havent filed a CCJ and it has been over 6 years BUT he was on an IVA a few years ago that failed, will this IVA go against him in regards to a statute barred debt?
Please help!! We dont have a clue where we stand

Quick question, does a debt become statute barred 5/6 years from the date of default, or the date or last payment and/or acknowledgment?0
