    Well i have just recieved the 2nd letter from Mucky Hall, the standard 72 hour, or we will be forced to Blah Blah Blah, even though it wasnt sent to my address, it was sent to my old address and they even got that wrong, a neighbour brought it around.

    Now my question is, do i now send them the Statute Barred letter, the Prove it i want the original loan documentation Letter, or simply ignore it again?

    I got a letter from these on Saturday asking them to contact them. I have this morning and the guy told me I owed £700 for a store card that was opened in 1996. It was sold by Creation Finanace to Cabolt in 2004.

    I said I had paid that off through a settlement figure years ago, but I don't have any proof or to be fair recollection of the debt.

    I haven't heard anything from any company on this debt for over 10 years so can't understand why I am now.

    Does anyone know what I can do about this???

    McKenzie Hall go around buying up old debts at a fraction of their value and try to collect on them.

    If you have not heard from them for 10 years it sounds like this debt is statute barred.

    The Limitations Act 1980 states that when the following conditions are met then the debt cannot be pursue through the courts.

    The conditions are:-
    • That the creditor has not taken court action against you, eg CCJ, AND
    • You have not made any payments on the debt over the last 6 years,AND
    • During the years, you haven't written to the creditor acknowledging that owe them money.

  • Thanks very much for your help. I will send the letter to them regarding been statute barred and to remove it from their files. They tried to tell me that Cabolt tried to contact me, but I explained to him that the address I had been living in from 2003 -2009 and I never received anything so they didn't try very hard. I am sure they will come back saying something but as I thought I had already paid this off and never heard anything in over 10 years and have not made a payment since I thought it was paid off then I think I am ok.

    Ok in the end I sent them the 'I do not acknowledge this debt' letter, I didn't sign it but I did put my initial, I thought that would be ok, I also sent it special delivery and kept a copy and proof of postage.

    Let's see what happens next.

    It is not unknown for Debt Collection Agencies to mislead about debts that are statute barred, indeed one has even been known to make a payment against debts.

    Thank you very much for the link, it looks like it could prove useful, I have made an appointment with the C.A.B on Thursday just to see if there's anything else I can do.

I too have recieved a letter from Mackenzie hall today - asking if I knew the whereabouts of myself and if I coukld contact them relating to a personal matter. I know what the debt is about - their email was [EMAIL="arrow.global@mackenzie.com"]arrow.global@mackenzie.com[/EMAIL] so I know its to do with a Capital One Credit Card outsanding balance of around £750. The debt date is from 2008 (so SB will not apply)

    Now, I have nothing against paying this debt, as it is obviously mine... but these people seem like royal crooks!. What are my options here - shall I contact them (which has been heavily advised against) and offer repayment terms?

    Or shall I try and contact Capital One to see if I can deal with them? As i'd feel more comfortable with this.

    Also, i'm concerned as my credit rating is improving all the time and this is the final outstanding debt from my stupid student days that hasn't been fully satisfied... please let me know if you have any advice - i appreciate the effort eveyrone has put in on this thread to help people similar to myself.

    Ok i went to the C.A.B who basically said ignore them, and bin them.

    However she did tell me something i didn't know, which was if you write to them asking for details of the debt, that can be classed as acknowledging the debt.

    Now i am sure that has been pointed out here previously, but i was unaware of that tbh.

    I received a letter saying I owed £1780 giving me 2 days in which to pay, as I had no unpaid debt I rang them only to find out it related to an account held 17 years ago at a previous address & in my maiden name, I had left the address 2 years before the debt, on their advice I telephoned the police who told me that they were not interested due to period of time that had passed & that Mackenzie was 'trying it on' as it was an issue over 6years old & regardless of it being my debt or not I should not have been sent a letter due to the Limitations Act 1980 I wrote to Mackenzie stating this (& again the fact it was not my debt)who immediately wrote back stating 'upon investigation I can confirm that your account is now deemed to be statute barred, and is therefore protected under The Limitations Act 1980' obviously they knew this when they contacted me & was just hoping I didn't know about it & pay up, if it hadn't have been for the fact it was not my debt I would haven't have known, for anyone who’s had a letter from them I suggest they read the Act it was good advice from the police!
