    I had the "we want to know if anyone lives there by that name letter" for, what I believe is a Barclaycard debt last paid approx 5 years ago.
    I was made homeless after I fell pregnant so all my money was going on getting a place sorted for me and my child, and, tbh, a lot of other things were going on and I didnt get in touch with them to let them know what was going on(post-natal depression amongst other things). I will not be in a position to make any payments until I return to work later this year.
    Anyway, do I contact them and ask them what it's about or just ignore it and wait for them to get in touch again? Also, is it not illegal for a debt company to sell a debt on to another debt company because of data protection? This debt has been "owned" by 3/4 different debt companies, to which I have sent "prove it" letters to, not getting any response from them and then getting a different company asking for the debt.
    If I hear from them again, what do I do? Just ignore it? Is a statute barred debt also going on when the last payment was made or when the last transaction took place?
    I dont know what to do because I dont want a CCJ or any bad debt in my name - I am hoping to buy a house with my partner is the next couple of years and don't want his credit report to be downgraded because of my credit history.

    Ignore it until they get in touch outlining what they are really after.

    No it is not illegal for debts to be sold on. Provided they are not in dispute.

    The SB clock starts from the last payment you made.

    what do you mean by over 6years? its 6years since what? when you took the account out? when you last paid them? or what.
    It will only be statute barred if you haven't paid them for 6years, haven't written to them to admit you owe the money for 6years and if they haven't obtained a CCJ against you.

    it has been 6 years that they were last paid as they stopped taking the direct debits out of the bank. I have not wrote to them or anything since then as I thought it had been paid

    What is the further action they are on about?
    could mean sending you more letters, could mean instructing a DCA to visit you at home, could mean taking you to court to try to obtain a CCJ, its intentionally vague.

    What does the first paragraph mean? ("Despite previous correspondances you have failed to respond. We have obtained this alternative address as a financial link, linking this address to your previous abode. This financial link information was supplied by a credit reference agency,)
    It means they wrote to you at your previous address, you either didn't respond or someone sent your letter back to them and so they checked your credit file using your old address and it showed them this is your current address (the 2 addresses must show on your credit files). As its the second letter to this address presumably it also refers to the fact that you ignored the last letter from them.


    They sent an earlier letter to this address, but I ignored as it was very vague basically asking if I am the person to call them


    Should I contact them to agree a payment plan even though I thought the debt was paid/?

    Check your credit file, if there is no CCJ against you and it definately is six years since you last had any contact and that includes payment, then it is statue barred and they have no legal grounds to recover the money. There is a template letter on this site which you should send.
  • Hi, I've received a letter from these as well 2 days ago regarding a "personal matter" First thought was that a long-lost relative had pegged it & had left me a legacy(!) so googled MacKenzie Hall & discoved they're a bunch of chancers who buy up old debt. The letter wasn't properly addressed though, they used my middle name instead of my first name, the only unpaid debt it could relate to is a BT Cellnet account from 1998 which Cellnet wrongly opened in my middle name. The account was in dispute as the phone had been stolen, & would not be replaced ( even though it was insured!) until I'd paid the bill in full. The amount owing was only about £35. I've moved house twice since then so would like to know how MacHall got my current address . I'm waiting for next letter to see how much they expect me to pay, it'll go the way of the first one - in the bin- or heh,heh use it to line the cat litter tray & then send it back to them!
  • Had a phone call from Mackenzie Hall today before work, they have my previous married name, have been divorced from my ex for 5 years and remarried last year. They have rung again this afternoon and I asked them for the information they hold, they have some correct details and a lot that don't match. The person on the phone was very rude and suggested I report the mismatch to the police as I was obviously committing fraud. I asked for the details of the alleged debt and she said she didn't have to provide this I just had to pay as it was my debt. I don't believe it is as the info was just too mismatched, will they provide the info?

    Did they have your address Mrs R12?
    If they did they might write to you - and if they do write to you then send them the prove it letter. You certainly don't want to be paying anything until they have provided proof that this is your debt.
    Chances are it won't be your debt. If it does turn out to be yours and is a very old debt, then before you pay you need to consider if it would be statute barred (come back for more advice if it is your debt).

    If they call again tell them to write to you and hang up.

  • I keep getting text messages from these clowns telling me to "contact Callum urgently quoting reference XXXXX" etc.

    I'm really biting my tongue not to reply and telling them to go to hell in no uncertain terms, but I'm holding back for the time being as I'm worried if I do that my number will become 'live' and they will harass me all the more.

    HOWEVER the strange thing is my mobile number is pay as you go, its not registered and I very rarely give my number out to anyone, so how Mckenzie Hall have got hold of it is a mystery.

    What should I do?
  • I keep receiving texts off them asking for a cristina lopez and that i need to get in touch with them urgently. I dont owe any money anymore as my debts are all paid off and my name is not cristina lopez. How did they get my number? Are they dodgy?
