Don't call them. Their trick is usually the "contact us to discuss a personal matter"...or..."we're trying to trace Mr XXX at this address, please call the number" letters first. Then a month or so later they'll either send another, more detailed, letter outlining what and who you owe money to, or...they'll disappear off the face of the earth, like they did with me. Twice.

    Complete bunch of jokers.

    Hello again,

Thank you so much for your help, that has eased our minds somewhat. The debt is an old one for sure so we shouldn't have anything to worry about then. We won't call them but just wait for their next move if there will be one.

    Best wishes!

Eventually they'll write with details of what it is. It either be:

    1. something ancient - covered by his bankruptcy

    2. nothing whatsoever to do with him
  • My sister has received the exact same letter, i said i would look into it for her so goggled it and was intrigued by a link that said debt collectors or scam. In a round about way ended up here and have read this forum ( not fully LOL ) from beginning. From reading replys as far as i can see the best thing to do with this company is file there shoddy PRINTED SIGNATURE letter in the bin.

Well, that depends whether or not your sister actually owes the money.

    What does the letter say?

The usual threats! If you paid off the debt 4 years ago then just ignore them.

They aren't allowed to send anyone to your doorstep, if they do they have no right to anything and you should tell them to go away.
  • I just received a letter from Mackenzie Hall stating that they have been attempting to contact the person named on the letter (me), regarding a personal matter and to contact them immediately quoting a reference number.

When I contacted them they advised me that I owed them £758 for a kind of loan or debt which was organised (apparantly by me) on 29 November 2004 with Clydsdale Financial. They added that I would have to pay the oustanding amount.

I let them know that I couldn't possibly have anything to do with this loan or debt as I was serving with the forces in Iraq from October 2004 until May 2005.

The advisor added that it may be the case that I have been the victim of identity fraud and that I should get an incident number for them to close the case.

They didn't actually appear to have the information surrounding the debt to hand either.

I am absolutely baffled by this and would appreciate any help from anyone on what I should do next or where i stand.

Best advise? Don't bother calling them again lol

If you are sure the debt isn't yours then there's no way they can enforce it. Not only that, if you've not paid anything towards this debt (I assume you haven't seeing as you know nothing about it), it's over 6 years old and Statute Barred anyway. Just ignore them, I have a feeling they won't be in touch again.

MH have obviously bought a bunch of bad debts recently, because this thread has got rather active of late.
  • 1. Dear Sir or Madam,

    Account Ref xxxx

Please be advised that I will only communicate with you in writing. I have noted your repeated attempts to contact me by telephone over the past few weeks/months and these have been duly logged by time and date.

Furthermore, should it be your intention to arrange a “doorstep call”, please be advised that under OFT rules, you can only visit me at my home if you make an appointment and I have no wish to make such an appointment with you.

There is only an implied license under English Common Law for people to be able to visit me on my property without express permission; the postman and people asking for directions etc (Armstrong v Sheppard & Short Ltd [1959] 2 QB 384
. per Lord Evershed M.R.). Therefore take note that I revoke license under Common Law for you, or your representatives to visit me at my property and, if you do so, you will be liable to damages for a tort of trespass and action will be taken, including but not limited to, police attendance.

In Scotland change the last paragraph to :-
There is only an implied license under Scots Common Law for people to be able to visit me on my property without express permission; the postman and people asking for directions etc. Therefore take note that I revoke license under Common Law for you, or your representatives, to visit me at my property and if you attempt to send such a collector to my home, you will also be reported for harassment and I shall seek damages for a delict of trespass. You would also be liable for conspiring in a delict of trespass by acting in defiance of my instructions and sending someone to visit me nevertheless. Should it be necessary, I will obtain an interdict from the Court to prevent you carrying out your threat.

    Yours faithfully,

send them this letter recorded delivery lol then wait till they break the law then the tables are turned hope it helps
  • Thanks folks, just couldn't think for one minute what the amount could be for. Feek like reporting them for wasting my time. ha ha
