    I also have recieved a letter from MH saying who they are acting on behalf of which is Lloyds TSB. This letter is the second letter and it says they have been

    "Despite previous correspondances you have failed to respond. We have obtained this alternative address as a financial link, linking this address to your previous abode. This financial link information was supplied by a credit reference agency,

    We have been instructed by our client to recover the overdue account on their behalf.

    Our clients have informed us that they are unaware of any legitamate reason for non-payment of their account and although they would prefer an amicable settlement, they will not hesitate to take further action as may be appropriate.

    We trust this will not be necessary and you will send the payment by the deadline below

    Payment Deadline; Noon, 1st April"

    So a few questions

    as this debt is over 6years can they still force me to pay or is it statue barred?
    What is the further action they are on about?
    What does the first paragraph mean? ("Despite previous correspondances you have failed to respond. We have obtained this alternative address as a financial link, linking this address to your previous abode. This financial link information was supplied by a credit reference agency,)

    what do you mean by over 6years? its 6years since what? when you took the account out? when you last paid them? or what.
    It will only be statute barred if you haven't paid them for 6years, haven't written to them to admit you owe the money for 6years and if they haven't obtained a CCJ against you.

    What is the further action they are on about?
    could mean sending you more letters, could mean instructing a DCA to visit you at home, could mean taking you to court to try to obtain a CCJ, its intentionally vague.

    It means they wrote to you at your previous address, you either didn't respond or someone sent your letter back to them and so they checked your credit file using your old address and it showed them this is your current address (the 2 addresses must show on your credit files). As its the second letter to this address presumably it also refers to the fact that you ignored the last letter from them.

    it has been 6 years that they were last paid as they stopped taking the direct debits out of the bank. I have not wrote to them or anything since then as I thought it had been paid

    They sent an earlier letter to this address, but I ignored as it was very vague basically asking if I am the person to call them


    Should I contact them to agree a payment plan even though I thought the debt was paid/?

    I too just did the Experian thing, just to get cash back from Quidco - got a letter form mackenzie hall today, just after my cancellation letter from experian!

    No don't offer to pay it - at least not yet.

    Have they specifically mentioned in this letter the details of the debt? who the creditor was and what account number etc? in short are you sure its your debt they are chasing?

    If you know its your debt and you think its statute barred send the SB template letter you can find on this thread - https://forums.moneysavingexpert.com/discussion/2606811 (post 2 or 3 depending on where you lived)

    If you are not sure its your debt you could either send the prove it letter http://forums.moneysavingexpert.com/showpost.php?p=11570893&postcount=2 and wait to see what they produce and then send a SB letter or you could send a letter like this one - which disputes its your debt but says if it is it would be statute barred - http://forums.moneysavingexpert.com/showpost.php?p=39267708&postcount=5

  • I received a letter from them today, not that I'm debt free but I manage my debts so know 100% I haven't got anything not paid or outstanding. When I phoned them, they were after someone with the same name as me; they promised to remove my details but we'll see.

    my wife has today received a letter from mckenzie hall (in her maiden name),stating they need to speak to her over a personal matter.
    she has in the past been a victim of fraudulent debt brought on by her ex partner,most of which have now been either cleared or written off,although i believe the one debt is currently still being paid off. these debts go back quite a few years,i couldn't say exactly how long.
    reading these pages i can see ringing mh is a bad idea.
    as she has no idea what this letter relates to (though we are assuming its another fraudulent debt) am i right in thinking we should do nothing at the moment?
    also is getting legal advice an option as i can't help feeling these debts will continue to raise their ugly heads and at the end of the day none of these debts are her own doing.

    I just got a letter from them, but it relates to somebody else. They told me that the DOB was totally different and mentioned an address in blackpool and I said I've never lived there.

    They said they will disassociate it and they won't bother me anymore.

    Eric - for just a letter as vague as this then ignore it. if they send a later letter actually giving the amount they are chasing or the details of the debt then at that point you might need to consider chasing the prove it letter and taking it further.

  • thanks tixy,we're as certain as we can be that it will be a fraudulent debt as there have been a few. as i'm sure you and everyone else on here will agree its something we can do without. its not even as if its a debt we've ran up ourselves thats the aggravating part.
