Quick question, does a debt become statute barred 5/6 years from the date of default, or the date or last payment and/or acknowledgment?

The latter ... despite what debt collection agencies will tell you.

There was a specific court case (can find and quote if necessary) where the judge declared that it would be unfair for a creditor to be able extend the limitation period by choosing when to issue a default notice.

My partner has recieved a letter from Mackenzie Hall today demanding that he pays over £3000 by noon 25th July - the date on the letter is 18th July.

As far as we know the company havent filed a CCJ and it has been over 6 years BUT he was on an IVA a few years ago that failed, will this IVA go against him in regards to a statute barred debt?

Please help!! We dont have a clue where we stand :(

This came up once before and I think the conclusion was that, if the debt wasn't statute barred before the IVA then the time period starts again at the date the IVA was terminated.

Sit tight and see what their next move is.

    Hi All,

Apologies if this has been answered above, but need some clarification on this. I received a letter from MH today for a £4k BarclayCard debt and I'm a bit confused as to it's implications.

The card was taken out at an old address when I was 18, but I didn't really pay the bill because I was young and stupid (I'm 35 and have hopefully matured a bit now). My concern is that this may well have resulted in a CCJ against my name back then, but can't be sure as I moved soon after and subsequently did not receive any court orders or paperwork. I've checked my credit file and there is no hint of this on my report.

Is this debt still enforceable after 11 years if it was a CCJ? - (11 years assuming 6 years since last contact). I have not had any contact with BarclayCard nor MH in this period, nor have I paid anything to either of them.

    Please help!

Only with permission of the court.

But really you're approaching this wrongly. Until/unless Muck Hall assert that there is a ccj (Have they quoted a county court reference like 6QJ12345? Thought not!) then this is just so statute barred it's got mould on it.

Send them the statute barred letter.

    Thanks Fatbelly,

There is no reference to a CCJ nor court reference in their correspondence. I got some mapped out payment plan of £40 per month that I should by by DD to stop a "door step visit to my property by their field collectors, MeritForce".

I've read a couple of earlier posts that suggest a CCJ is collectable despite it's age and just wanted a bit of clarification. It also states that "if I am not the named person, please contact us quoting reference number: xxxx to stop any further communications". Sounds like they are fishing, but wanted to know what the situation was with a "statuate barred" CCJ.

    Again, thanks for your reply...

Don't talk to me about MacKenzie Hall, I am plagued by her message several times a day on my busy switchboard! I pick up the call and there is a recorded message saying "This is a message for ********, MacKenzie Hall would like to speak to you about a personal matter" it then goes on to give a list of options and buttons to push, by this time I have disconnected the call.

With over 1200 employees in the one site this happens several times a day and is getting very annoying.
  • I got a letter from MH today, and suspect they've been calling me too. Based on what I've read on this board, the formula in their letter is a fairly standard one - requesting I contact them on a personal matter...

I've no idea what it is they're chasing me for. Can I find out without actually contacting them?

What is the best way to respond? Not sure whether I should just ignore or contact them...

    Thanks for any suggestions...

Ignore them for now. They'll either write to you telling you what it is, or go quiet.

I don't like this thread. The vast majority on here seem to be receiving a letter from MH, and basically trying to worm their way out of paying a debt.

If you built up the debt, you should have to pay it back. End of story.

MH contacted me a few months ago, and I paid back what I owed.
