after six year u dont have to pay anything. but still expect them to hassle you by phone and letter as u have given into their 'fishing' by contacting them...
  • I also received a letter from MacKenzie hall over the weekend, asking me to contact them regarding a personal matter.

I know what it's about, seeing as the email they gave as a contact was e.cabot. Cabot was the debt collection agency that was used to chase up a debt I had when I was 18, nearly 10 years ago. I am doing the same with this as I have done with previous letters received, and that is binning them and getting on with my life.

    Number of points...

    1. file_wizzard is spot on with his advice... OP - if the creditor has not YET got a ccj then send the above letter with £1 fee and send recorded delivery to ensure they get it.. they then have to provide proof of the debt within 12 days... If they havnt by 30 days then THEY are comitting an offence...

And you should then report them to Trading Standrads and the OFT...

Make sure they provide proof that the debt they are collecting is legally owed by YOU... DCA's do chase the wrong people for debts and it is your legal right to request this info.. If they CANNOT provide the signed agreement then LEGALLY you do not have to pay them - there is nothing LEGALLY they can do to you... These are your rights as a consumer.. so dont be intimidated by MH or any other DCA...

And yes tootsie roll is an ex DCA - he was a membe of DHUK (of which I am a m0oderator) and was banned from there for being a humourless nuisance (generally)... did have one laugh regarding the tart test...

hi all sorry to re drag up an old post, but i have just checked my credit report and there has been a default registered by mackenzie hall in 2009,if they have purchased the debt and i have had no conversations with them are they allowed to just register a default?
  • How does one stop these people hassling an innocent party: I am continually getting debt collecting letters from them and despite pointing out that the idividual lives about 60 miles away (a former relative - wife of deceased brother) the mo%ons cannot seem to correct their records having assumed that my surname means she lives at my address

They are hassling my kids by phone and text and letters on some occasions addressed to 'occupier' at my address.

    Help........................
  • Hmm. In some ways it's reassuring to know there are others in the same boat. Having been a hardworking single parent (after leaving a domestic violence situation with absolutely nothing) who got myself educated so I could provide for kids rather than living on benefits, I went through some really difficult times when my priorities were really basic - food etc. I still find dealing with money stuff incredibly stressful. About 2 weeks ago I got the letter from MacKenzie Hall asking me to confirm my details and phone them. I ignored that. Today I letter saying they're persuing a debt for Cabot Financial re a Barclaycard debt for nearly £500. Like other people, I went through a tough time about 12 years back when I had to move out of the house I was renting because my landlord was selling it. This was Middlesex & I couldn't afford anywhere else (most Council Houses were sold + I wouldn't be eligible until I was homeless & lived in a B&B as I was working so shouldn't need one!). I also just finished social work training & split up with my boyfriend and decided to start again in the North where I had some family and rents were cheaper and I would find plenty of work (like Norman Tebbit said). I got a Barclaycard to get my kids beds and some basic stuff for our new home. This was set up so that payments would be deducted from Bank Account. Can't remember exactly what happened, but at some point Barclaycard stopped taking payments. The years went by, I moved a couple more times, got married and now have a mortgage and must have assumed they didn't want any money a good few years back. I still have the same bank account (Barclays!) so I figured they could contact me.

Anyway, what seems to have happened is Barclaycard lost me and sold the debt to Cabot Financial, probably as a job lot. Their friends at Mackenzie Hall are just starting a campaign of intimidation to get me to pay up & I would guess, add additional costs over time.

I have checked my credit rating and it is all good with CCJs recorded, so they must just have the original debt & tracked me down. I am sure this must be statute barred but am reluctant to contact them at all. Can they do anything apart from sending me letters of deeper shades of red?

Sorry to ramble on but these guys make me mad, since they prey on the vulnerable and are bigger crooks than the ordinary people who have been forced by the finance sector to depend on them (and I'm one of those public sector workers who may well loose my job because of them)
  • just read back what wrote - sorry again for whining on - it should "NO CCJs"
  • I have received two letters now from these people, but they are addressed to someone that sounds a bit like my name, but spelled totally wrong.
The debt in question is one that I don't actually think I owe, and if it is, it will be at least 8 years old (I have had a mobile phone with the company they say the original debt is from, but I am not aware of any outstanding money owed).
I have not phoned or written back to them.
Any advice would be gratefully received as I am beginning to get a little concerned.

Bin it. Debts over six years old are unenforceable anyway.
  • I just had one from them today claiming I owe money to barclaycard. I know a few people in here have said around £500 but to be more specific mine says £484.45

I don't have a barclaycard or ever remembering having one although I do have a Barclays acct with debit card. Trying to remember if I had one when I originally opened but that was 13 years ago and I don't think I did so this is going in the bin.
  • We had one a few months ago and we knew we didn't have any debts so just chuck it in the bin
