  • I've had those as well. I don't understand why they do that text thing if they need to speak to you urgently, and already have your landline number.

These people have been ringing and texting me all week and been very rude. They refused to tell me what it was about until I gave them my name address and date of birth. Who in their right mind would give someone that information. I just can't believe they are so rude.

After looking online and seeing they were debt collectors I called the three companies I have had loans from in the past to check to see if anything was outstanding. One of them said I owed £11.76p and the debt was now with MH. This is from a loan of £3,000 that I paid back on time and had no letters chasing. I have not changed addresses since taking out the loan. I can't believe I am getting this grief over £11.76
  • TAG, without wishing to add fuel to the fire so to speak you are indeed correct and TR (Troll) is an Ex DCA, and although some of his post are indeed factually correct and well meaning he does have a tendency to incite argument and hence (under various screen names) he has been removed and banned from various other boards for what some consider to be inappropriate conduct.

Nonetheless, he is correct in a lot of his statements, especially that some people tend to use these boards as a route to debt avoidance rather than debt resolution.

Anyway, with regards to the OP’s original question Mackenzie Hall do specialise in time expired, or hard to recover debt, they are also (allegedly) known to write to people on a purely spurious basis in regards to debt related to other people with the same or very similar names, and they are also known to “aggressively pursue” these cases.

The best bet for the O.P is to send a letter something similar to that which I have attached below, and wait for the deafening silence in response!

If they do continue to pursue after non-compliance to the attached they should be reported to your local trading standards and the OFT as appropriate.

    Courtesy of the “Debt help uk Board”;

I do not acknowledge ANY debt to your company. I require you to supply the following documentation before I will correspond further on this matter.

    1. You must supply me with a true copy of the alleged agreement you refer to. This is my right under your obligation to supply a copy of the agreement under the legislation contained within s.78 (1) Consumer Credit Act 1974 (s.77 (1) for fixed sum credit) - your obligation also extends to providing a statement of account. I enclose a £1 postal order in payment of the statutory fee, PO Serial Number xxxxx.

    2. A signed true copy of the deed of assignment of the above referenced agreement that you allege exists.

    3. You are notified that you are obliged to supply these documents, whether you are the original creditor or not.

Non-compliance with my request is a criminal offence under the above Act and will result in a report being submitted to the relevant statutory authorities.

This letter can be used for ther DCA if the debt is purchased, or the original creditor if the DCA is acting as a recovery agent on their behalf, if / when they have confirmed that they have the right to recover then you can evaluate your options.

Thanks loads, I have just received a letter from MH, very intimidating !
  • Hi All,

It's my first post. I;m very unsure of what to do here. I have received 2 text messages on my mobile in the last 2 weeks asking me to get in contact with Mackenzie Hall and they have asked me to quote a reference number when calling them. I had no idea who they were at first, and since reading that they are a debt collecting company, it's got me fairly concerned.

However, I have NO debt whatsoever. Any credit I've had - phones, car etc- have always been paid off in full. I have never had a bank loan or ever defaulted on any payments (as far as I know) and I've only this year been given a mortgage with no problems. My wife also has impeccable credit history, so I'm very confused as to why I have received these texts.

What should I do? Any advice would be very much appreciated.
  • Have a look at my template letter on this thread.

Remember, they are breaching the OFT guidelines by insisting you give personal information to prove you do not have a debt.

You may have to quote the actual sections of the guidelines breached to the Financial Ombudsman Service if it gets that far, though.

Even if you did owe £600 from 1997, chances are it's Statute Barred.

They play on the fact a lot of people aren't aware of their rights, and pay up through fear.

We should all get together one day and go and see these morons in person. I bet they wouldnt speak to us the way they spoke to me on the phone.
What ever we say about muck hall at least they give employment to freaks that couldnt get a job anywhere else. How could anyone with any self respect work for a company like muck hall. Theres a lot of dodgy debt collectors about but muck hall are the worst by far. Its about time the OFT took there licence.
  • Hi All
I have received a letter from Moorcroft saying that my account has been passed onto their HOME COLLECTIONS TEAM and someone MAY call if I dont ring up before the 28th October at 10am.
With my father been poorly at the moment after having a heart operation I dont want these people calling to our home.
I owe £2500 to Lloyds for a credit card and £1000 on a loan from Lloyds. Both my accounts are with Moorcroft and I rang them two weeks ago and I wrote to them explaining that CAB were working out a monthly plan for me as Ive just returned to full time work but still I get this letter.

Should I ring them and explain again or do something else?
    Thanks all

Do nothing. They are hardly likely to come out and see you. It is not cost effective. It is simply a threat to intimidate you into making a payment.

And even if they did knock on your door, just tell them to go away. They have all the powers of your local paperboy. None at all.

I'm sorry, I don't apologise. That's just the way I am. Homer (Simpson)
