However all may not be lost.
Of course you should pursue it but do you know anyone that's handy at sewing?
I know and agree that the state it has arrived in is in no way acceptable however it does seem to me that if the dress is ruffled, lacy, with crystals etc. then it should be possible to get this repaired and cleaned at relatively low cost.
If it was a straight satin dress then a rips are going to show a mile off, but if it has lace and detail on it then it may not be a massive write off.
I would take the advice of a local dressmaker and see what's possible.
62 crystals might sound like a lot, but it might only take someone 2 hours at £10 an hour, so I don't think you need to think in terms of a complete write-off.0 -

The dress arrived this morning in a black rubbish bag......I just couldn't believe the dress arrived in a black bin bag.....
Why do you get hung up on the black bag? The black plastic won't stain the dress........it has several rips, tears, holes and stains on it, there are all 62 missing crystals on the dress.....
That is the important bit, that should concern you (not the wrapping, bin liner or no bin liner)!.......I have contacted the seller again but of course no reply.
You only received it this morning. Give the seller time to reply. It's too early to turn the thing into a drama (just yet).0 -

Was this sent to you via the postman? Do you have the senders address?
If so then I would do the following:
Write to them, send it via Special Delivery, tell them you have opened a Paypal dispute and that they have 14 days from receipt of letter date to repay you, via Paypal.
If you get no response form this letter you will be filing with the small claims court for your money back and they will be liable for any further costs this action incors.
Then wait the 14 days. Make sure the payment has CLEARED and you have it back.
If they do not pay you can make a claim here: https://www.moneyclaim.gov.uk/web/mcol/welcome
It will cost you £30 but anything that it costs you gets added to the award. Make sure you keep the dress and all of the packaging. You will probably have to return it - ONLY RETURN THE DRESS BY SPECIAL DELIVERY. Keep everything,letter, receipts, special delivery receipts.
You have lost your money today so try and see if you can find something else to wear, however you will be able to get your money back one way or another.
If you do not have your address speak to Consumer Direct and also your credit card company and tell them what has happened.

I opened a claim with paypal a few months ago and it was sorted within 2 weeks, I got a full refund from them as they decided in my favour. They may ask you for more info (they did with me). It wasnt for as much as yours but I dont think you will have a problem. I was like you - worried sick I had lost my money but I am sure you will get it all back and wont have to wait as long as 30 days.0

I think Paypal will usually cover you if you can prove the item is "significantly not as described". I had to raise a dispute with them a while ago over an item (similar value to yours) that had been delivered to me in poor/damaged condition. Paypal didnt make it an easy process and it was a lot of hassle but I got my money back in the end.0

I disagree. A wedding dress should be sent in a much better format! A black bin bag would only serve to create wrinkles in the dress and leave it open to the possibility of damage.
For example, the bag, and therefore, the dress can tear very, very easily. And once that bag is open, it's also open to stains.
I wouldn't even send a T shirt to someone in that manner, let alone a wedding dress!February wins: Theatre tickets0 -

DO NOT, I REPEAT DO NOT, file a claim and use "significantly not described" as the reason for filing the claim.
If you do, PayPal will Email the seller and say that you have opened a "significantly not as described" claim. Then, all the seller has to do is click on "file a full PayPal claim" and PayPal will then instantly decide in favour of the seller, close the claim, and there is NOTHING that you can do.
DO NOT file as "item significantly not as described".

I have opened a significantly not as described dispute, I thought this was the right thing to do?????? I am so upset, the dress cannot be repaired as it is damaged all over:
I have just had a reply from her:
"I told you that the dress was dirty underneath which it is, you only asked if the dress had marks on. The stones came loose whilst it was being cleaned and this was unavoidable. The stones can easily be replaced as the claws are in place. I am sorry you are not happy with the dress but I think the dress is in good condition to wear again with slight repair. You have paid £400 for a £1600 dress. I would not expect anymore for that money. It is an exspensive designer dress that has been worn once and professionally dry cleaned. The photos I sent you were taken the day before it was baged up. The bin bags that I packaged in were used as the dress would not fit into anyting else that was sold in the post office. I do not accept refunds and I would have told you this before I sold you the dress if you had of asked."0 -
