No you won't be able to go through small claims nbut wait to hear from Paypal, it'll take a good few days just for a response - she cannot close the dispute, only Paypal can do that.

IF that does not work then get onto your credit card and speak to them (you might want to do this now anyway). I personally think that you'll get a response from Paypal.

How did she send it? Have you contacted Preloved to see if they will pass her information to you? Tell them what has happened as well. They should be able to give the information if you have been scammed. If they refuse to then contact Consumer Direct and see what they say.

It's a horrid story!! So sorry for you.
I think you just have to bide your time and wait for PAYPAL. If they don't come through they should at least be able to provide you with her address and then you can seek the small claims. But just give PAYPAL some time.
    Good luck

Hang in there Kim, it might take some time but keep us updated on here when you hear something.

Was there anything on the package - even a postcode from the sender? How did she send it?

DO NOT, I REPEAT DO NOT, file a claim and use "significantly not described" as the reason for filing the claim.

If you do, PayPal will Email the seller and say that you have opened a "significantly not as described" claim. Then, all the seller has to do is click on "file a full PayPal claim" and PayPal will then instantly decide in favour of the seller, close the claim, and there is NOTHING that you can do.

DO NOT file as "item significantly not as described".

    Best of luck

    What a load of rubbish!

Its clearly a case of the otem being SNAD and the correct process is to raise a paypal dispute on this basis. I went through the same thing and although they were a bit difficult to deal with, paypal eventually sided with me and got me a full refund.

I would definately give paypal a chance to resolve the issue in the first instance.

Hang in there.. you never know, the seller might do the right thing and give you a refund.

    Hi
It was sent standard parcels, the postcode on the sticker says BD6
She said she was going to send it insured etc but no signature was required it was just left downstairs, it was sent in a black bin liner.
Earlier she wrote me that message but she hasn't replied to paypal yet, I thought she would have but maybe she is going to ignore it? I was wondering when do I get a chance to email paypal all my photos? I hope I get to say my side too, Kim

I didn't reply to her earlier email, I just didn't know what to say, she seems to have made it clear I'm not going to get a refund and she was also really mean basically telling me I'm stupid for not asking before. I think I will wait to see if she responds on paypal by the 24th and go from there. I don't think I can do small claims without knowing her address.
