I am sure the dealer will have some contractual agreement to underpin their safety from being driven out of business and become scapegoats.
We need to be selfish and explore any avenue we feel will get the cash from these dodgy dealers, who have already received OUR cash back from service providers (3g,T Mobile e.t.c) and have conviniently "forgoten" to pass on the cash back to us the innocent customers.0 -
Contractual agreement? That must be one with God - NO-ONE else is going to bail YOU or THEM out. In fact, I would think they are your ONLY potential hope in getting any cashback - since they are the only ones who might salvage it and if they aren't around, game over. In fact, your interests have to be aligned WITH them. Given support rather than attack they might survive. Without them you have nothing. If only life were like we wish. This situation has arisen many times before and (no doubt) will be repeated in the future. At least on this occasion the owner doesn't appear to have done a runner and seems to be doing everything he can to explain what's happened and stay in business so he can repay everyone. Oh well; I tried, though I've seen before how anger and emotions defeat clear thinking and understanding. I am offering impartial and objective advice; I don't expect it's what you want to hear and you probably won't heed it, but if you are determined to bring them down, you will - in which case I reckon you can kiss ANY chance of your cashbacks goodbye.0

Do you suggest we keep quite, do nothing, and live in hope that we will get our money back? You know very well this is not going to happen.
I am open to any other suggestions you may have that will help hundreds of Click Mobile victims. I strongly believe exposing both the dealer and the service provider could be the answer.0 -
I think you'd do better if you want to approach the BBC etc. to do it in support of the company, to put pressure on the relevant networks to honour their commitments to the company and pay the money they appear to owe it. If the networks pay the company, there's a fair chance it will pay you. It says it wants to and is doing all it can. I think joining forces with it to put pressure on the networks WITH it rather than attacking it is your best chance. Not to go putting in claims and court action; it is clear the company would go under if that were to happen and all you'd have achieved is kill off your chances and spend more on court fees etc. Under normal circumstances I'd be all for pursuing them through the courts, but it seems to me this is not a good idea in this unusual case. Personally I can well believe the company has been misled and stitched up by the networks, but you have virtually no direct comeback against the networks. The company may have that comeback (hence its own legal action etc) and working with them rather than against them would seem much wiser here.0

I am in the same position as most of you. Havent received my cash back and now its 2 months over due.
I think the best course of action is to to take legal action in a small claims court, this costs £50.00. This will put a charge against the company and if it is trading or going to be taken over by auditors then they cant ignore a CCJ against 'Click Mobile Uk'.
I have checked on Equifax and 6 people have already put CCJ againsts Click Mobile UK and Companies House still state they are trading.0 -
Are you able to see if the 6 registered CCJs have been paid.
CCJs only get registered if the Defendant fails to pay the Claimant within one month of the judgement being issued - Defendants who have got the money to pay will want to do so as they are left with an unblemished credit record.
It seems Click have not paid 6 judgements promptly, and this may mean they have no funds, and don't care too much about their reputation.
Don't rely on the fact that Companies House shows them trading.
Their register takes time to show status changes, and it does take some time to wind up any company - whether by voluntary liquidation or going bust and giving up etc.0 -
Those 6 CCJ’s have not been settled. Five of the judgements were in September and the other one was in July.
I have just come back from the Uxbridge County Court where I handed in my Claim Form against ‘Click Mobile UK Ltd’, it cost me £45. I thought it is worth a try, as this way I have more of a chance of getting my money back than waiting and doing nothing.
Also something interesting I noticed when looking into ‘Click Mobile UK Ltd’ was they made £230k profit in 2006. It is possible they are being investigated for money laundering or anything else, hence the bank accounts being frozen which is what the Inland Revenue / Customs, rather than them going bust.0 -
I really would like to know Where mobilejunkie is receiving the information from, regarding being patient because the dealer is trying to do someting about it. About IT??? > He is no where to be seen. He has not written to any of his cuctomers. Last week we saw his staff on a Sunday at the Shop in Hounslow being emptied during the Night. Come on mobilejunkie, get real tell where your info is coming from. At least with Click Mobile competitors Chattererbox.com have actually writen to their customers of their intetion and released an official statement on th WEB. What has Khan and Mahmood done. I have bee to their place numbe of times and every time have been given C**k and Bull story. Lying through front teeth.
Kalsi i think you are on the right lines, however, i do not think we will receive anything form these crooks. Al we will have done is to name and shame them. I myself have lost in excess of £1800, my best solution is to negotiate with the networks for a reduction. PS the time has come to move on now. Time for Damage Limitation.0 -
I took the advice and cancelled my DD and they are now charging me an extra £3 per account for not paying by DD, so I am forced to reinstate my DD.
I wrote to 3 and all they suggested is that I can cancel my contract wef 21 October by paying all the remaining months contract, i.e. paying up to Dec and not using the facility.
I told the customer services person that I am not stupid to pay for an early termination and then also pay to the end of the contract (because I am not allowed to cancel the contract before it expire).
They suggested and gave me the address of clickmobile to write - but the shop is not trading anymore, so letters will be simply dumped through the letter box and not answered.
What can we do now to get our money back. I am owed £1260

Lyndaz,
Take my advise, forget the Cash Back, Forget Cancellation, be polite in your letters and ask for affordable downgrade. I have successfully downgraded to the lowest tariff with orange. I am being advised many friends that 3 are doing the same. However on individual basis. We HATE Khan and Mahmood. !!!!. They have really brought misery to oridinary innocent people lives.0
