  • I suggest that ALL those affected should write immediately and directly to their Network provider (T-Mobile, Orange, 3, etc) and send copy to the Trading Standards Office and Companies Investigation Branch.

The letter must include the contract details with dates, cash back amount, when was it due, what action you have taken so far to recover the cash back, etc.

It is our hard earned money that we have currently lost. We got into the contract in good faith and trust but Click Mobile has tricked us whilst they enjoy the fruits of our labour and pain. Is it fair?
  • I don't know how the cash back scheme operate. My guess is that the network provider must be giving the dealers a fixed amount or a percentage of the contract value from which the dealer returns the cash back to the customer. Otherwise there is no way the dealer can give anything back to us.

Please remember, you sign the contract with the dealer and receive free phone from dealer but you do not pay anything to the dealer. Even the direct debit is with the network company not with the dealer. WAht is the source of income / receipt for the dealer. Therefore, we have to take up with our respective network providers also.

Therefore, the Network company must know wha is going on.
  • I wrote 2 letters to 3G and their call centre phoned me upon receipt of both letters.

I informed them that since I have written formally I would really appreciate a formal response instead of a phone call.

However, I have yet to hear from them.

I have taken an advice on this thread to cancel my DDs (x3) with clickmobile and I am afraid that I might now come on the "bad credit history" but if I don't I am paying £105 per month!

    Have anyone heard from 3?

If you just cancel the direct debits, and your contract is continuing, then not only will your credit rating be affected, your debt will increase as well.

3 will continue to bill you, but because they cannot use direct debit, they will add £3 to every bill (the fee for non-direct debit payments).

But simply not paying the bills will result in far more than a "bad credit history". This can escalate with you finding the debt much higher, expensive collection agencies getting involved and you being unable to get any credit in future.

See if you can come to some arrangement with 3 before it gets nasty.
  • My advice to anyone on 3 who has been affected by cash back problems from any dealer like Click or dialamobile , bash.com etc would be to call 3 customer service and raise a case and the will call you back within 4 weeks with any offer.
  • Just joined this forum. I called up T-mobile today and talked to the cancellations dept. They said they know of the 'Situation' (not problem!) and that we cannot cancel our contract. All they offer is a measly £5 discount. Now getting a £5 discount on a £50 plan is a complete joke. I was as polite as possible and the only other thing we can do is wait till the 11th month and then downgrade to any plan. She also added that Click mobile has said that they are looking into the situation and will be contacting T-Mobile and advising them on the cancellations(which I believe is complete Bull!!).

Now if you look into the law in this country, we can do - nothing! The police refuse to take a complaint, Ofcom ignores it, The trading standards says F off to everyone unless its a fraud in excess of £1 Million. So basically all you guys can do a company fraud for less than £1 Million and your chance of getting caught is as high as Tony Blair becoming the Prime Minister again!

I have been in touch with BBC Watchdog. They could highlight our plight if we all write to them.
All mobile operators are not helpful and threaten court actions and bailifs if we do not pay up.
Suggest we all write/email BBC watchdog so they can track the owners.

Also this site has suggestions about a letter.

  • I suggest people read the thread on Mobile Connections. It covers the same ground - you're all just a few months behind. However, I think there IS one important difference with this one. In your shoes I would give this company a chance to recover - the letter earlier on this thread and other publicity suggests to me they may have been "stitched up" by the networks and the owner really is doing his best to get through an extremely difficult period and then pay people. I know that may sound a bit tenuous - and it is - but it's almost guaranteed that if you kick up enough fuss and drive them into the ground no-one is likely to see a penny. If I had a cashback contract with them I would be desperately hoping you give them breathing space so I might eventually see some of my cashback. I am not on their side; it is my honest belief that another crusade will work against you and not for you in this particular instance.
  • Whlist we all want Clickmobile to recover, it will do no harm is raising the issue using BBC watchdog. This will enable us to get the likes of 3 and T Mobile to support Clickmobile as well.Hence a new crusade through BBC will not only help us but also Click Mobile.I urge every one to contact BBC immediately.

  • Misguided. All THAT will do is make the networks drive the company out of business. They will treat them as a scapegoat even though by all accounts it was the networks who have caused the problems in the first place. Of course, it's your money - but a lynch mob will simply end up lynching the crowd and not the real culprits!
