  • my daughter did have income support for herself with a disability premuim, this premuim was income suopprt. Maybe you are missing out on payments from income support
  • thanks scarlett for the info, i will try get help with filling in the child tax credit form which i have had for sometime. I have had a look at the website but i find the figures a bit confusing as to what to put. I have seen some sites on here where a lot of people have had to make repayments to ctc as they may have misunderstood the forms. With the overpayment that the dwp are now taking i dont want to make a mess for her. The overpayment can only be suspended when an apeal starts and because they havent released details of the interview under caution this is holding things up and the overpayment will continue to be paid back until the appeal starts. The request has been applied by phone and in writing by the mp and the law centre, i cant see really what they are delaying things for

    Chel, looks like you are on the right road now, I am glad to see. I hope everything works out soon for you & your daughter.

    My reason for asking Scarlett about IS was because my IS was stopped a few years back, obviously I don't know your daughters full circumstances but from what I have read they seem similar to mine. When I re-applied I was told I wasn't eligible for IS anymore as the rules had changed. No one mentioned child tax credit to me for months, then it was the council tax office who told me to claim it!! I did and have received that ever since. If memory serves me right you just need to write your total taxible income from the previous tax year. You get the equivalent to a P60 from the DWP every year, and use that total. There may well be a part relating to savings, that didn't apply to me :( I can't see how on benefits they can over pay you? I would expect that is only working people who's income increased.

    It has been the easiest form out of them all for me & the renewal is no hassle at all. You may well be right and I could get a premium from IS, and the origional decision was wrong! I just took the decision without doubting it. If I can get the strength & willpower to fill out another form I will give it a go again.

  • thanks for reply. I am confused about the form as her income support was stopped in april this year so will i put income from last april to this april. I think if it based on this it will look on paper that she is receiving more money than she actually is and the ctc will be less then. Can they backdate from when the income support stopped for the child and would it be advisiable to include a letter to explain the circumstances.

    Chel, does the form ask for 2005-april 2006 income? Or present income? If it is last years then I would put it in & add a cover letter stating that IS has stopped and there is an over payment, but as yet you don't know how much.

    As advised before, please get help from CAB or other welfare benefits advisers about this, it will get sorted out much quicker. At the moment you could be costing her cash by messing about with these forms.

    Chel has said she has the law centre and MP helping her. I think she is only asking about the CTC form now.
  • hi there, when repaying an overpayment can anyone tell me which benefits they can take the repayment back. I have been told that they cant take dla into account when working out deductions. Is this correct.
  • hi there does anyone know about the debt management, i was informed that once they receive an apeal they stop taking the overpayment back whilst the apeall is sorted out. They have said now that they dont stop taking overpayments until the apeall has been looked at. I cant find any good information anywhere. It seems that even though an apeal has been lodged with the income support you then have to apeal to the debt centre. Very confusing
  • hi please if anyone can help with the question of ..when people are on income support why are they not changed to child tax credit, the rules on child tax credit are different to income support
