  • the housing !!! have advised to go to the law centre, but have an appointment with welfare rights 2morrow. A new claim has been submitted to housing benefit but they say that there is a backlog of claims and it will only be looked at if notice of eviction has been served...thanks. My daughter has been ill with it all and had been admitted to hospital over the weekend.I have had some good information on this site and without it i think i would have lost my mind before now

    if the money is in an account of a single person who is claiming benefits then that money will be regarded as being that persons savings, is this what has happened to your daughter, it is her and her ex husbands money and not the friend's :confused:
  • no it was the friends, maybe he was doing this and trying the buy her house for his gain.He did a lot of work on her house and enhanced it greatly. When the family got on to him he has changed his phone num and details. I think she could of maybe lost the house which he intended to buy.

    Chel, you are obviously in a terrible situation and going through an awful lot with all this. Your daughters health is a terrible worry for you and you are doing the best you can to sort it out. I am sure you are posting when things go round in your head and it must help to know you are not alone.

    There are things I haven't understood, how could another person hope to buy your daughters house? But the answer doesn't really matter. What matters is you have somewhere to ask your questions, vent your frustration in this complicated situation. Do anything that helps you. I am a good listener and happy to help anyone if I can. But you do need professional/legal help for this. When do you see a solicitor?

  • any help on child tax credit, how long does it take to process a claim. Can they backdate and claim. The information pack looks a nightmare and yet the form to send back is really thin an looks easy to complete

    I applied online and received money a couple of weeks later, the sooner your daughter fills the form in and sends it of the sooner she will receive the money. I dont think it can be backdated although I dont know when you think it should be backdated from, but your daughter must be honest when filling in the form so she dont get herself into a bigger mess.

    CTC replaces the child element of Income Support, so if your daughter does get her IS sorted out she will only get money for herself.
  • thanks. When her income support stopped earlier this year, it wasnt known about to claim child tax credit for her child. I did think that if they stopped her income support there was nothing else we could have done. Hopefully now there is light at the end of the tunnel as income support has been reinstated and good avice from the law centre has been given regarding her housing benefit etc. The system is very hard to understand without having people in the know
  • Chel, with the best will in the world, your case seems so complicated you really must get proper legal advice.

    e.g'. It's not your daughter's money ( but it's in her name?)

    Someone is trying to buy her house (Does this mean put up the money to buy a Council house?)

    That same person put HIS money into HER bank account?

    This person is not her husband or partner?

    The husband, however, although not on the scene, has a joint account with your daughter?

    The person paying for the house has now withdrawn all the money (How, if his name is not on the bank account?)

    Now her means-tested benfits have stopped because they are saying she has too much money? (I'm not surprised - I don't understand it either).

    PLEASE get proper legal advice asap.

    right the income support that has been reinstated, is this the whole amount or just the element for herself, if its the full amount of Income support then she wont be entitled to Child Tax Credit as the child element will be paid through IS :o
